Okay so I just got laid off from my job this morning. I worked at a CPA firm and about 2 weeks ago my check was late. I had rent due and they told me they mailed it out. The owner just wrote me a check right on the spot and said to bring him the other one when I received it and if I cashed it I'm out of a job. So since I'm out of a job as of this morning, low and behold the check arrives. Can I cash this as it's a legit check? I mean he didn't have to write it out....
He already paid you for the late check, if you cash this other one you're receiving money you didn't earn. They could sue you. If you decide to cash it, and they sue you, you have no defense. Why? Because the only reason the owner paid you on the spot was because you both knew another check was coming in the mail. Rip it up and throw it away.
