  1. DENVER - The first person to be arrested for possession of marijuana in the city after the passage of Initiative 100 will not be going to trial. At a news conference held Wednesday, 29-year-old Eric Footer, announced charges against him had been dropped.
    Footer was arrested shortly after a law legalizing possession of up to an ounce of pot was approved by voters in November.
    Regardless of the vote, Footer could have been prosecuted under state law, which outlaws the plant.
    Prosecutors said they didn't have enough evidence to go to trial, according to Footer.
    "I see it as a personal victory, but more I see it as a victory for all the people who voted for the initiative; the I-100 initiative," Footer said.
