Likely this week, Representatives Maurice Hinchey (D-NY) and Dana Rohrabacher (R-CA) will introduce a vital amendment to the Commerce-Justice-State appropriations bill. This amendment, if passed, would prohibit the Justice Department from spending funds to interfere with the implementation of state medical marijuana laws. For the past few years, in a series of highly publicized cases, the DEA has ignored the will of the voters in California by using federal law to criminally prosecute patients and caregivers, including Ed Rosenthal, Brian Epis, Steve McWilliams and others. Should the Hinchey/Rohrabacher amendment win approval on Wednesday, the DEA will be legally prohibited from carrying out similar raids in the future. In addition to stopping the raids and protecting medical marijuana patients, this amendment will be the first time since 1998 that members of Congress have been forced to vote on record about medical marijuana. This is a rare opportunity to find out exactly where your member of Congress stands on the issue of protecting medical marijuana patients from arrest, prosecution and prison.
