A recess appointment has beend done before in fact a dozen times regarding the supreme court. Do you understand what a recess appointment is? It is a loophole that doesn't require congress. It is an executive order and Obama loves executive orders he would make juliius ceasar blush.

And only if the Senate fails to act on any legislation for more than three days. I re-iterate. The Republican controlled Senate will never allow an Obama nominee to sit on the Supreme Court.

Cruz and Rubio yesterday both said they wouldn't even entertain Obama's choices at all; they wouldn't even go through the process of confirming or dissenting.
