    PART X-E. THERAPEUTIC USE OF MARIJUANA
    §1046. Prescription of marijuana for therapeutic use; rules and regulations; secretary of health and hospitals
    A. Notwithstanding any other provision of this Part, a physician licensed to practice medicine in this state and who is also registered to prescribe Schedule I substances with the Drug Enforcement Administration may prescribe marijuana, tetrahydrocannabinols, or a chemical derivative of tetrahydrocannabinols for therapeutic use by patients clinically diagnosed as suffering from glaucoma, symptoms resulting from the administration of chemotherapy cancer treatment, and spastic quadriplegia in accordance with rules and regulations promulgated by the secretary of health and hospitals and in accordance with FDA and DEA administrative guidelines for procurement of the controlled substance from the National Institute on Drug Abuse.
    B. The secretary of health and hospitals, by January 1, 1992, shall promulgate rules and regulations, authorizing physicians licensed to practice in this state to prescribe marijuana for therapeutic use by patients as described in Subsection A of this Section.

    (31) "Practitioner" means a physician, dentist, veterinarian, scientific investigator, pharmacy, hospital, or other person licensed, registered, or otherwise permitted to distribute, dispense, conduct research with respect to, or administer a controlled dangerous substance in the course of professional practice or research in this state.

    (32) "Prescribe" means to issue a written request or order for a controlled dangerous substance by a person licensed under this Part for a legitimate medical purpose. The act of prescribing must be in good faith and in the usual course of the licensee's professional practice.

    (33) "Prescription" means a written request for a drug or therapeutic aid issued by a licensed physician, dentist, veterinarian, osteopath, or podiatrist for a legitimate medical purpose, for the purpose of correcting a physical, mental, or bodily ailment, and acting in good faith in the usual course of his professional practice.

    §1024. Exceptions; defenses

    A. Any provision of law to the contrary herein notwithstanding, the provisions of this Part shall not apply to the manufacture, sale, distribution, or advertisement of any product or object designed and sold primarily for scientific research, industrial, veterinary, or agricultural purposes, or for bona fide medical or clinical use.

    B. It shall be an affirmative defense that the person to whom the drug related object or advertisement or notice was distributed had a prescription from a licensed medical practitioner or psychiatrist for marijuana or the controlled substance for which the object is primarily intended to be used. It is also an affirmative defense that the drug related object was designed or marketed as useful primarily for veterinary or agricultural purposes.

  4. Wow!!! That's not right that they would only legaliz Marijuana in the N.O and not the rest of the city's. I live in Shreveport and you wouldn't believe all the people that smoke.

    Nah if it was up to me I'll legalize everywhere lol.
    I just don't see other cities in louisiana going for legalizing weed. I can only see N.o getting it legalize & being super laxed about it. Thank about it Burbon st. already a alcohol/bar/strip club heaven. I don't see why the city wouldn't be ok with legalizing it and opening up a dozen or 2 "Coffee Shops/Smoke shops" in between the bars and clubs on burbon, Only allowing people to smoke inside the smoke shops & roof tops/ balconies......Basically Making it mini amsterdam of the south, or america for that matter. Another multi million dollar major tourist attraction other then mardi gras. I don't know man, I can really seeing that happening realistically with no problem from the law here.

    Only on burbon & surrounding streets tho. Other cities in la wouldn't want to ruin their repetition like that.

  6. I think a state legalizing it is one thing but I don't think a city would. They would be going against the Feds and the State. Activists don't really work on changing local cannabis laws unless it is decriminalizing not legalizing.
     
  7. It's changing. I was born in southeast Arkansas and have lived here and there in the South all my life. Missip had the best laws so far with decriminalization at 1 oz = misdemeanor ($200 fine, I think?). I'm in north Arkansas now and the state has a medical mj initiative on it's ballot this year (doubt it will pass, but it's a foothold).

    The biggest inhibitor to change in the South really is the churches; however, it's the old folks in the churches. I think most would be surprised at how liberal a vast proportion of the population is on the issue of MJ in general. It's just that our oldest generation is so entrenched in their beliefs on marijuana that we're afraid Gran and Pops will disown us if we even broach the subject.

    Bad enough to actually do a little work? Every time you see an article about legalization or Alzheimer's, you post something like this-

    Here a good reason marijuana should be legal. In 2006, WebMD compared THC from marijuana and Aricept. This is a quote from the article.....

    Marijuana May Slow Alzheimer's

    “THC blocks an enzyme called acetylcholinesterase, which speeds the formation of amyloid plaque in the brains of people with Alzheimer's disease.


    The Alzheimer's drugs Aricept and Cognex work by blocking acetylcholinesterase. When tested at double the concentration of THC, Aricept blocked plaque formation only 22% as well as THC, and Cognex blocked plaque formation only 7% as well as THC.”


    Why would anyone in their right mind take Aricept, when you could grow a more effective herbal medicine, marijuana, for pennies a dose....if it were legal for medical use!
