Worried about growing in apt as CO Caregiver..

  1. Hey guys,

    So, I aquired my medical card and a friend to sign me as his caregiver in Colorado. Seeing as this gives me 6 legal plants to grow, I have been growing in a very large storage closet in my apartment. Now 2 grows have finished and 1 is just starting again and I get a letter from my landlord saying they are doing room inspections on those moving out in August. Since I am, and it's way earlier than I would have guessed they'd do the searches I'm worried about them finding out.

    I've cut a hole through the drywall to vent the closet which I was planning on fixing when I moved out. Do you think I should quit the current grow now and fix the hole in the wall? Hide it? Talk with them about growing legally and get permission? I'm not sure what I should do, so I'm asking for advice. Thanks a lot.
     
  2. if you live in like a big apartment complex i doubt they will give you permission to grow.

    if you are in a situation like me and rent from a average joe landlord, then i would say ask for permission, i asked mine right before i signed the lease and he said he was cool with it since i have my card, i to live in colorado.
     
  3. I would never want to grow in a place I am renting, there are a lot of potential problems that could occur even if your landlord agrees with it initially. If your landlord doesn't know about it I would get it out ASAP.
     
  4. just my idea... but get your shit out of your apartment and maybe let a friend keep it for a day or two? if that's possible
     
  5. I could get the place cleaned up so they wouldn't know, but then what if they do want to do repairs before we move out or something? Now I'm worried, but I don't want to say goodbye to the 6 lovely gdp ladies :( If I'm covered by the card, what is the worst that can happen? Maybe I should just look for a new place thats more legit to start back up in August when the lease is over.
     
  6. You're actually not covered by the card. Land lords can kick you out, you can be fired from your job, etc, even though it has been deemed legal for you to grow, possess, and use marijuana. The card grants you no rights whatsoever.

    This same thing happened to me and I knew the hadyman doing the inspections. I told him my situation and he was cool with it.

    At the end of the day at least in Cali my attorney said messing with a caregiver situation is bad juju, legally a "caregiver" is someone that has legal control over another individuals wellbeing, (wiping asses, housing, nursing and stuff like that) I would be more worried about having more plants under this "arrangment" than them finding out about your plants, I had twelve plants in a closet 3x7 and I vented the exhuast to the cieling with no carbon filter lol pretty funny looking back.

    You are moving out in the next couple of months, I wouldnt worry to much because if there is nothing stating that you cant grow there in the lease you should be fine, although they may hit you with the repair of the drywall or oder control if they cant get the smell out (corp always look for ways to fuck you especially apartments). They may look at the clause that says anything illegal is grounds for eviction, however you could prove you are legal...well unless this caregiver setup cant be proven. My two cent....good luck! Awesome I always wondered if I was the only one that would hack an appartment up and grow some dope right under thier noses lol. Ipatched the holes and moved out with my deposit, maybe you will too.

  8. dude, GO FOR IT!! seriously you live in CO man I used to live there, they are PRETTY LAX about the shit, they know its legal so what can they do?? as long as ur legal they probably wont give u a hard time unless they have any reason to...ur not hurting them or ur neighbors by growing...unless ur landlord is a bitch about it....and r u SURE that your landlord will be coming to do the inspection??? because mine never really came in...just the maintenance guys or whatever to double check everything, or one of the clerks that did paperwork with me n shit...dont worry about it though seriously, they will not flip out cuz u are LEGALLY GROWING.....in the rental paperwork it PROBABLY said nothing about growing any PLANTS indoors im sure.....

  10. Im in an apt and I have a whole room dedicated to growing. Just be smart and I think they have to give you 24 hr notice before entering. All in all, they are probably going to be the most pissed that you cut a ventilation hole in their wall than anything else. Thats typically something youll lose your deposit over...

    its a rental...why the hell would you modify it without giving notice????


    colorado is being hit with the same shit that cali(more specifically humboldt) is dealing with. people come in and rent houses or apartments, gut them, then expect to be covered by there card. this RUINS our image by the people who dont grow or have a card. much less makes us look bad to landlords.

    check out some houses for rent on craigslist humboldt. a lot of them say no growing. colorado will be this way soon to if we are not careful of our grows.

    granted your grow is small so at least you didnt trash the whole place for the grow, but still you are in a apartment, and definitely should have just saved yourself the hassle and just asked before you did anything. imo

    edit: or you could have done what i am planning on doing, and that is going with a grow tent. with these there is no need for holes in the wall, and no need to worry about people seeing it. they may be able to physically see the tent, but from my understanding you cant see whats in it, and if set up properly you sure as hell wont be able to smell it! plus i asked my landlord and luckily he said that would be cool if i grow a few plants lol. colorado is a cool place for sure, but i still think we gotta use our common senses
     

  12. There is some bad advice in this post. There absolutely does not have to be anything in the lease about growing cannabis, caregiver or not. This could end up being a very bad situation for you if the landlord finds out. I think some of you people believe that just because growing for patients is legal on a state level that somehow means you can grow wherever you want and that is not the case.

    So, in the letter it says the landlord and the maintenance man are both coming in to check. The landlord is kinda chill, but definitely seems to do things by the book and would probably gribe about fire hazard or something. The maintenance worker is ok, but seems like her puppet lol. It says in the lease 'tenant shall alter the unit in any way without written authorization from landlord' which I have already done, whoops. I have 6 days til the inspection, so should I ask for permission now and just hope they say yes? Or should I take everything down, fix it up, then restart again under their noses?
     
  14. Take it all out a couple days before, move it to a friends house or something. If you can't just rent a storage unit for a month, it will be worth it. Fix that wall though, you don't want to lose your security deposit, they'll take any reason to keep it.
     
  15. wtf....why would u just up and leave WITHOUT even finding out if they would care??? a hole in the wall can be fixed EASY AS SHIT!! it costs like 20 dollars MAXIMUM to fix a hole in the wall....so rather than making a pain in the ass move that will probably fuck up your plants light cycle n shit, just find out first if they would care....I do not see WHY they would give a shit, theyre probably glad there is a hole in the wall so they can charge a BILLION DOLLARS to have it fixed, I dont see how that is bad advice or how that gives people who have cards a bad rep really, it can be fixed and isnt even a big deal, ur signature and credit is on the lease and so obviously ur gonna pay for/fix any damages???? think about it....as for the caregiver shit, that would be the only thing i would be worried about...but if u guys can take care of that i would just talk to the maintenance person or whatever
     
  16. i wouldnt leave them for the landlord or maintenance man to find. or even tell them.

    doesn't matter if you have a card. they can do whatever they please about it. id try and hide all that shit during the inspection and worry about the hole when its time to leave. most people in those kinds of positions are not pot friendly in the first place.
     
  17. There are many reasons why a landlord would care. And there are many reasons why you wouldn't want to just admit you are growing in their apartment:

    1. People are still getting busted by the feds for growing cannabis, even if it's legal on a state level.
    2. No matter how many people support cannabis/medical cannabis, not everyone does.
    3. They can instantly decide you need to move out.
    4. Insurance is another big issue. If something were to happen and, say there was a fire or something like that, the landlords insurance may not cover it. This might mean that the landlord will be coming after you in a lawsuit for loss/damages.
    5. If you are going to talk to your landlord about growing, do so BEFORE you start growing, not when you think they'll catch you.

  19. since youre in colorado, im sure you heard about the guy the DEA just raided not too long ago? come on man. its obvious we still need to be pretty discreet with our favorite plants.

    that guy was a 100% legit grower medically and they laughed at his ass all the way to prison im sure. or will.

    just dont risk it bud, its still a gray area legally, and just because youre a med patient doesnt really give you any extra rights, ultimately if the landlord says you cant have it there (which they probably will, unless they are a med patient) you cant have it there, regardless of your medical card

    a lot of people do not approve of medical marjijuana and as stated before, your card really DOESNT give you any extra rights, it just excludes us from prosecution. you getting evicted for growing in there apartment is still totally fair game.
