Why is Has More Illegal Than Pot?

my friend that lives in NorCal got pulled over and he's a medical marijuana patient. He had an eighth of hash and some normal bud. The cops confiscated the hash and said that it was illegal, mostly because it's not a natural product, like you have to go through a process to make hash, it doesn't just grow on plants, or some shit like that. Just a few days ago he hit me up and a local club called him asking him to call some officer and he was sketched out as fuck. so my buddy calls the cop the club told him to and the cop said since you have your card the hash is legal and the cop told him to COME GET THE HASH from the station hahaha. so he goes to the station and gets his hash back. if you don't have a card i believe hash is a felony.

edit: and to answer your question, i think it is the same kind of legal logic that makes crack more illegal than coke.

 

What state and what exactly was he charged with? Possieon of a controlled substance? It chouldnt have been "possieon of marijuna" .

In my criminal and civil justice class if I remember correctly, we learned any amount of marijuana is considered a felony.

 

In many states, concentrates are a felony.

Because it's stronger they try and classify it as a different drug so they can make more money. I was arrested and thrown in jail for three days for hash possession and I'm a legal patient. I had less than .5

 

Haha i just saw this episode, the guy didn't even know what kief was! This is another reason i hate police, most of them are more ignorant about the drugs they confiscate and come in contact with than the general public and the people that deal with them. You would think they would have to take some kind of courses about drugs and guns and other illegal stuff.

haha hell yeah, i just watched that episode as well. It was definitely in california, i think san bernardino (close to LA) if im not mistaking. What i'm wondering is why the cop said that the county they were in didn't recognize medicinal marijuana. I thought that counties followed state laws and couldn't arrest medical patients but apparently i was wrong.

Well what he was just a stupid cop, what he meant is the county at the time of filming, along with SD county, wasn't allowing mj dispensaries/recommendations to be made because they violated federal law. Well, it went to trial and thank god it is over and they now have them, i would hate living in a county with a card but no dispensary, even though my county doesn't have any, yet. And that guy definitely should have been arrested for dui, did you see how blazed he was lol. I mean, until there is legitimate research done about driving stoned, i think they should punish people for driving under the influence. But i feel that the punishment should not be very severe, maybe just a ticket or a night in jail, just to make a point.

 

Just watched the episode as well. The fat lady with the cannabis leaf tattoo on her arm was hillarious.

 

He definitely shouldn't have been driving, that's for sure. But he was doing alright for awhile. He didn't consent to the search, and made the officer try to sweat something outta him. The kid never should have mentioned hash...gave the cop probable cause to search the car. And it wasn't even hash, it was kief.

That fat lady was a riot. The lady she was beating up was extremely histrionic. I thought the cop was gonna punch the guy when he wouldn't stop yelling! This was definitely one of my favorite episodes and I'm glad they aired it again. My wife kept repeating, "they are FUCKED UP!" over and over.

What a great show. I watch it almost religiously: 8pm on Saturday nights on Fox.

 

I also just watched that episode, and thought it was completely retarded that the kid got busted for hash. DUI, absolutely, he was fuckered up... but like others said, it was kief, not hash...

I was yelling at the kid the whole time though... shit like "DUDE!!! ROLL UP YOUR WINDOW BEFORE YOU GET OUT OF THE CAR... oh fuck... dumbass" and then he gets out of the car, and without the cop saying another word, he puts his own hands on the roof of the car and pretty much gives the officer permission to cuff him and arrest him. I didn't hear him give permission to search the car, but dude left his door open and window open. He could have saved himself a LOT of headache by watching the "how not to get busted" videos... but anyway...

Excellent show... the fat lady was epic funny.

 

He did have hash, the cop was just too dumb to opne the grinder. He opened it upside down at first, so the kief catcher is what he saw, the hash was on top of the pollen screen, the guy even told him.

 

it varies state to state. in ny pot was a misdemeanor, and i believe its been dicriminalized to where it's just a fine...correct me if i'm wrong.

in az everything is a felony. a gram-felony. paraphnelia-felony. Most of the time it gets dropped to a misdemeanor, but still. felony for a gram? shit boggled my mind when i found out
