    Federal prosecutors are set to appeal U.S. District Judge Charles Breyer's sentencing of “Ganja Guru” Ed Rosenthal.

    While the lead federal prosecutor, George Bevan, asked for a 6½-year sentence, Judge Breyer departed for sentencing guidelines which demand a 5-year minimum and imposed the lightest possible sentence of one day, already served, and a $1,000 fine.

    Rosenthal has already started the process to appeal his felony conviction, arguing that it was unfair as Breyer refused to allow the defense to present evidence that the marijuana seized was for medical use, legal under Proposition 215.
