 The state governments are not sovereign.  It is an extension of the United States.  Since they are not sovereign, they are bounded to power only EXPRESSED in the United States Constitution. The US Constitution, federal laws, and federal court rulings have deny the state governments all powers expressed in United States Constitution except regulating commerce and their own properties which can include their corporation and the state's adopted children. State government s doesn't have authority to regulate anything beyond commerce and their properties.

Commerce is to buy AND sell of goods and services or the transportation for the purpose of buying and selling.  In some legal dictionaries, you sometimes will find the word “trade.” Trade means to buy and sell (dealer).  You may find the word “exchange” in the new edition of black law's dictionary. That can mean a broker who sells a service with a product.   Commercial is activities relating to commerce like business loans, bailment, promissory notes, etc.  A good is a thing desirable to a segment of the population and has value.
 
How it is applied in court?
 
 In escort prostitution sting, the presumption under state law is the prostitute is a victim and the John who operates a company of Johns comes to purchase the prostitute and a bunch of horny Johns rape her.  Then the prostitute is sold on the black market after the rape to other Johns.
 
If the John rebutted the commerce and the corporate presumption, the judge may re-contract under the Model Penal Code. Under the Model Penal Code presumption is that the pimp rent out prostitutes to the Johns for sexual gratification.
 
Commerce and commercial activities requires goods being purchase and sold. Without the “good” there is no commerce or commercial activities.  Without commerce or commercial activities, the courts have no jurisdiction over the matter.  With escort prostitution cases, there is no good that are bought and sold but services rendered..  In order for the court to have jurisdiction over an escort prostitution case, there must be the presumption of human trafficking.  Without the presumption of human trafficking, the courts don't have jurisdiction.  If the defendant doesn't rebut the presumption of human trafficking, the presumption stands as truth in commerce.  Once the human trafficking presumption is rebutted in affidavit and in trial, the courts loses jurisdiction over the case.
 
Without the presumption of drug trafficking, the courts doesn't jurisdiction over drug possession.  If the defendant doesn't rebut the presumption of drug trafficking, the presumption stands as truth in commerce.
