  4. They have tried this before, the 10th Amendment was very poorly written, the supreme court always finds some kind of clause that conflicts with what it says in the Amendment.

    Also if they find that the these states are breaking the 14th amendment in anyway, this won't be allowed. Those two amendments conflict each other numerous times, and more often than not the 14th Amendment is sided with more because of the poor wording in the 10th Amendments clauses.
     

  5. Or more so to do with judicial activism. Strict constitutionalists argue that the 14th amendment is unconstitutional because it undermines how the Constitution was originally written, federalism, and the 10th amendment. The 10th amendment is pretty straight forward in what it says.

    The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
