Small Claims Court

  1. Has anyone had experience with small claims court? If you remember correctly, I was the dumbass who posted the life ruining thread. I'm past all that craziness and just need some info. Long story short, a friend has owed me a good bit of money for about 3 months now. Used to be from hanging out every day to haven't seen or spoke to him to 3 months. He's been purposely ignoring me and I have found out he's been buying useless stuff and even paying his ex girlfriend's rent and bills.. so yeah, I'm a little irritated. I finally tried to confront him and text his ex gf and he happened to have the phone and all day I only tried to be nice and get to the bottom of why he wasn't paying me. He was being nothing short of an asshole. He said he had a lot of on his plate and he threatened to come to my work, beat my ass, burn the building down, slash my tires, etc.. He's too dumb to comprehend anything so arguing with him is no use. I stopped replying and just told him fine, we'll do this the hard way and mentioned court and now he's desperately trying to get ahold of me but that ship has sailed... He does whatever his parents tell him to, so I will try giving them a call and explaining the situation but most likely nothing will be done and I will be taking him to small claims court. What all do I need to do in order to get this done? I realize you have to fill out forms, etc. but anything I should know about it? Thanks blades

     
  2. You need proof of what he owes you, or it turn in to a he-said situation.

    I don't have paperwork or anything but I have texts messages with him stating that he knows he owes me the money and how much he owes me
     
  4. Cut your losses. Move on. Get over it. Stop having any sort of communication with that person. He will not show up, and stiff you on the judgement, assuming you have enough proof. 
     
    However much money he owes you, consider that the price to never see him again. Treat it as a valuable life lesson. 
     
    This is probably not the answer you're looking for. But court is a costly and tedious process. It's not like Judge Judy (which I watch every day)

  5. He won't do this call the cops. Sometimes you do need them. I respect authority can't stand it how some people say "fuck the police!" How about having your child grow up in a world without cops. I'm very happy my daughter is born in a lawed land. Sorry had to rant haha. Well depends what the money was for.

  6. Are we talking like.. $50?

    If you got texts from him prooving he owes you money you should be all good. I would go through your phone and mark down the dates and times of the texts so when you go to show the judge you won't be fumbling around for it

  8. Unless you had a legal contract of some sort for him to repay you for the loan, the law will not be able to do anything.   They've had numerous cases like this on Judge Judy the person never gets paid.

  9. I would recommend asking him to give you a certain amount every two weeks.  Even if it's only 20 or 30 bucks bi-monthly, it's better than nothing.

    Details: He owes me $400. I sold him a subs and an amp for his car for a price of $500. he paid me 100 about 3-4 months ago. I was lenient about his payments and said do it when you can. But now that he's been ignoring me on purpose and threatening to beat my ass, I kind of want to do something about it. But I guess I have to learn I might just have to move on.. ugh. it's just hard to let something go like this for me. And me being on a t break doesn't help the cause.
     
     
    I approached him a while ago and told him if he can't pay for it then give it back.. he said okay just give me back the 100.
    Then today he says he is not willing to do so because he's put too much money into the system and wont give it back. But he can't pay me?

    Cause if you do your in position for the ultimate dick move.

    Report the speakers stolen. They essentially were.


     
  12. And there's no use calling the cops on this asshole.. He's one of those "fuck the pigs" type scumbags who will always refer to me as a narc. Which I could care less about.. but let's be real. what are the cops gonna do about this? lol.
     
  13. ahhhh no. I wish I did. I bought them off a friend who bought them retail and he most likely does not have it anymore lol. That would be an ultimate dick move

    You could try and scare tactic him. Since it sounds like he's scared of going to court.. Pretty sure this is illegal but you could photoshop his name onto a court summons and tell him you can still drop the court meeting if he pays up.

    Just spittin ideas out now

    I've actually been trying to.. I told him something about court and now he's trying to be all nice and trying to get ahold of me now but I'm done with his ass after the things he said. lol and that's not a bad idea haha hey man any ideas are welcome. might have to face the fact I just gotta move on.

    I know it doesn't help now but next time get a bill of sale or even a IOU type thing.
     
  18. Respond back to his texts and ask what he want. Then tell him he has like 30 days to pay or off to court you go.

  19. This. Then you could have him agree to sign a IOU so you would have more evidence for court.
