Search and Seizure regarding Trucks

  1. Have a question one of you fine, intelligent, GC'ers might know.

    So say a cop pulls you over in a truck with an enclosed bed (canopy on it), and says he smells pot and wants to search you. So he searches the cab of the truck and finds absolutely nothing, is he allowed to search the back of the truck? What are the circumstances in which he would and wouldn't be able to search the back?

  2. Not sure if it's the same in the US, but here he would be able to search you on the spot, regardless of most curcumstances.
     
  3. i know in the US if your trunk and glovebox is locked they need a warrant, but trucks are different i think, maybe put one of those toolbox things in the bed near the back window and lock that to be safe?
     
  4. the whole locked glovebox thing i'm not sure is 100% true, atleast in NC, if a cop has permission to search the vehicle or probable cause which ever happens first haha, he also has permission to look in any part of your car... ask me how i know. and the locked glovebox isn't very inconspicious and will likely be the first thing he looks in if he hasn't found anything.
     
  5. smelling weed is enough to get your whole shit searched. if they don't have shit, and you know that, anything that's locked they need a warrant for. if he says he smells pot, but you know he didn't, tell him to stick it. the penalties are the same.
     
  6. they can pretty much search no matter what. even if it was illegal, im pretty sure cops would STILL do it. they illegally search all the time.

    if he searched your truck, he searched your truck. can he pop the trunk not that i know of, but probably cuase is anything the officer sees fit for a search.
