Roommate/Cop problem, legally search?

Thats a lame move of those roommates. Personally I would move the bongs/bowls just to be safe, but I don't think they can search your room without your concent.

 

I don't think the cops could, but Campus Security probably could, and they might confiscate everything. So just to be safe, I would move everything out just in case.

 

It depends on who is on the lease. If you are NOT on the lease, then you're basically fucked. If you ARE on the lease, then cops can search anywhere BUT your room (unless you got shit in plain sight, then it's game on for the piglets) if the other roomates consent to a search.

My ex roomie called the cops on me because he thought my little .2g ball of hash was fucking heroin (dumbass who is an ex stoner forgot to smell it!) Cops tore my shit apart because I wasn't on the lease. I had no legal grounds to get the possesion charge dropped.

 

Just make sure nothing smells even remotely like weed.

 

A few things to consider:

A search by a roommate of your room is not protected by the 4th Amendment. Constitutional protections protect you only from government intrusions of our rights.

She CAN invite cops in to search common areas.

She could give them probable cause for a warrant.. perhaps even a warrantless search.

She cannot invite them into your room, which should have the door closed... however, see also:
- probable cause
- search by roommate not protected by the 4th amendment.

Whether or not you are on the lease may or may not matter... this will all boil to probable cause. The cops are not going to be going through files to look at paper work.. that they will leave for the court - they will be looking for drugs and signs of them and they will be looking for probable cause either for a search or a warrant to search. Of course, just straight searching you and arresting you and leaving you to figure it out is also a possibility and not unheard of ...

There could be a lease/rental agreement violation.

Probably time to move on.. nothing good can happen.

 

If i were you i would go out and buy a safe and keep all of your shit in that. As far as i understand cop's can't force you to open a locked safe. It will also keep you're roommates away from your shit.

Anyways, I would suggest you do remove your pieces for sure. I'm sorry, women are vicious, especially with other women. If shes talking to her mom about it, you know everyone else around you knows. It's just a matter of time before they make that stupid decision to tell on you guys. Mom might even step in one day.

ive dealt with the "shitty roomate" situation b4 & yes i found somewhere else to stash my toys (i cannot fathom what id do without my big bhong.)

ive also learned that as soon as spoiled little juveniles get their mommy & daddy involved ,things usually dont boil over nicely & rarely in your favor.

ANY cop will unlawfully try to search and seize any illegal property they may think you be in possesion of. THIS IS ILLEGAL BUT MOST CITIZENS DONT KNOW! they dont have a WARRANT to search your stuff you or your room, they dont have PROOF other than word of mouth of your illegal activity.

SEARCH these forums for a post that has legal info i just saw it the other day here on these forums, something about NORML and a FREEDOM CARD.

the FREEDOM CARD clearly states your rights and that you do not allow the police to take those rights from you, and that they arent allowed to even question you when you deny them a search, and they cant molest/bother you or your home without a SEARCH WARRANT.

This one time i got pulled over with some bud in my car, the cop asked me if I had a problem with him searching the vehicle, I TOLD HIM I DID HAVE A PROBLEM AND HE DIDNT HAVE A WARRANT and he went ahead and took me from my car, handcuffed me in the back of his car and searched all my stuff finding my under an ounce of weed, WITH MY MEDICAL MARIJUANA LICENSE (here in california)

I still had to go to court, i still got a big ass ticket, that fuckign POS cop! I felt like I didnt have any rights, and that i was being stepped on, and unlawfully detained and searched.

I didnt know what to do at the time, still being rather young I just shrugged it off and paid the fines.....and lost my weed....

I wish someone with some trul legal knwledge could help mroe than me, I wish i ahd the legal help as well, I got Screwed, and no one else should be either.

P.S- get rid of any smells in yor living area, any ash in the ashtrays, etc. vacuum well with some scented carpet care stuff (99cent store) have aerosol air fresheners available.

Remove any and all pieces from your HOUSE and CAR and keep them either hidden outside or at another location. Remove any paraphenalia (sp?) rolling papers, cleaners, trays etc.

Make sure you dont have any rogue resin or residues smeared anywhere visible (a p.o officer would search every granule in the room, not sure about a reg cop)

You and ur roomates word against theirs.

 

For the smell problem, stop by your local headshop and pick up a can of Orange Chronic, it's supposed to be the best stuff to get rid of the smell. And check on youtube for "Flex your rights" that channel has some great informational vids.

 

What I ussually do is just smoke outside on the balcony, but thats just me.

Since leases last for a year and assuming you only signed for a year, your pretty much stuck until summer there. I suggest moving to a 2 bedroom apartment with your chill roommate so you can just smoke all you want and never deal with other girl again. It might be more expensive, but worth it.

Anyways, like they said, just move all your shit with other stoner friends and never smoke in the apartment again. As long as your name is in the lease, its pretty tricky for cops to just search your room without a warrant and to get one, they need something a little more concrete than your roommate's word.

HOWEVER! If your roommate is a true bitch and says you deal, well that could definitely take a turn for the worst. A guy I know ratted out a dealer and they searched his house without anything else but the guy's word. I don't know if that was legal, but from what I here, cops are strict when it comes to the dealers.
