police know your a toker but they couldn't arrest you or anything

 

no not really. when i get pulled over they ask me all the time, do you smoke weed, i'm like yeah i do, but they dont find shit and they have no probable cause to do anything, but i mean theres no logical reason you would have to do that, because then they would suspect something and that might lead to other things. like if you get pulled over and they remember you, since cops are dicks, they will prollly be like, oh its the kid who smokes weed, lets tear his car apart for anything, and if they find ANYTHING even like a stem or seed your fucked lol.

 

most likely a cop will give you a look like you have three heads or something, if the cop is feeling particularly asshole-ish that day he'll promptly shine a flashlight and ask to search your person.

 

the actual act of smoking isnt illegal, but all the steps to getting it is. buying/selling, possesion, paraphinalia, etc. all carry legal reprocussions, but just saying you smoke weed isnt illegal and therefore, they cant arrest you for it.

 

when i was in high school and we would hang out at the local chicken place (police department is right next door) the cop would pull up and say "stoners, please put your marijuana away!" just to fuck with us. but he knew we all toked haha he was okay with the jokin til my buddy start slingin to everyone in my home town. those were the days. the day the cop said that my buddy had a qp sittin in his drivers seat 5 feet away.

Some states have "internal possession" laws where they can test (usually saliva) you for a detectable amount in your body and cite you for possession (very rare, mind you). I doubt they would be able to do that, what with the obscurity and general lack of probable cause, but it's something to keep in mind.

In short, nothing would probably come of it... but do you really want to call that kind of attention to yourself?

 

this may be true, but if you do say that you smoke it you would most likely had to have either bought it or grown it, and then you would have been in possesion of it until you smoked it anyways. So I guess you could say that smoking it is illegal in a way as well. Or maybe im just stoned and dont understand what you are trying to say.

To the OP they could search you, but most cops who are not dicks would not waste time with that since they should assume your not stupid enough to say that stoned or while in possesion.

 

you hit the nail right on the head. thats what makes it all so confusing/fucked up. you can smoke it, you just cant go about any way what so ever to get to smoke it. its how the law fucks you.

 

its also (at least in oregon) not illegal to be high....so you can be high (as long as you're not disturbing the peace or driving ect) and you can smoke it, but you can't have it, grow it, buy it, keep it, find it, own things to smoke it or that have been smoked from.

 

I'm pretty sure that it would be 100% legal, but they would probably search you immediately. I've done worse though, a friend and I got stopped by a cop walking down the street while we were HIGH as shit, he looks at us and asked if we we'd been smoking, we're like "yeah" and he asks us if we have anything on us, which we didn't, and he wanted to pat us down and shit but I told him that "BEING high isn't illegal, what is illegal is having weed" and he's all like "Oh, well..... I guess you're right" so we got away free of charge

In several states, including my beloved (yeah that's sarcasm) Utah the DUI laws for weed are really harsh. If I get pulled over for DUI and they test me and I come up positive for weed, they don't have to establish that I was under the influence WHEN I was driving, only that I was driving having tested positive. So I could smoke a bowl and get charged with a DUI two weeks later.

It's this kind of stupid shit that makes it a crapshoot with walking up to a cop and saying something like that. If there's some obscure law he can jack you on he'll do it because you challenged his authority...you basically said "neener neener." Cops don't do neener neener very well.

I almost got arrested for underage drinking and they gave me the ole' breath test and I ofcourse blew zeros. I had been smoking a ton about half hour before. I told the cop that I had in fact not been drinking, but smoking marijuana. He then searched me, and all he found was my little green bic lighter. He was pissed because he couldn't do anything.

 

i dont know what the laws are like in america but over here in the UK even if you show a cop some bud he probably wont arrest you. in the UK, its practically legal! usuallly the most you get is a fine and community service, although you could go to jail for a while if you get caught growing or if you get caught with large amounts.
