    Can you get arrested for just being high in public? I'm saying if you got nothing on you. The police can't really prove that your high...

    Yes, public intoxication. I doubt anyone would do anything unless you're making a big scene.

    The laws in most states do allow the public intox. ticket for pot, but don't expect it. Seriously, the percentage of cops who carry saliva tests (which still don't really prove anything) too small to even worry about.

    as long as you don't have 0 tolerance duid laws, and a cop doesn't see you take off in a car after testing your saliva, you'll be fine. But they can test via field sobriety test, and possibly take you in for public intoxication. I saw a guy get arrested cause his car broke down in the street after he smoked. no public damage or anything. but the officer decided to test him for marijuana while he was fixing his car, and ended up arresting him for public intox.

    Yes they can. Put I don't think any cops would do that because it would be verrrrrrryyyyy hard to prove it (get evidence).
