Question RE: Medical Marijuana Card...

  1. I recently had a friend tell me that a close friend of his was denied employment at a legal office as an assistant because during the application/background check process they were able to determine that he had a medical marijuana card...

    This is the first I have heard a story like this, does anyone know if this is a common occurrence or how this works exactly?


    The obvious question I have is, will I be putting my employment in jeopardy should I choose to get one of their medical marijuana cards? (specifically in reference to any possibility of a paper trail sort of problem).

  2. The only way i could see this happening is if he had a county issued card. Which san diego does have a county marijuana card issueing program. But its very hard to get and costs alot of money. But from what i hear it gives you the BEST protection possible from the law, except for maybe instances like this where ur name has been placed on a list for employers to see.

    Also ive heard that tha shops will hook u up wayyyy more if u show up with a countu issued card, not sure if its true tho.

  4. The State Issued ID card is 100% voluntary. Most people can't afford the additional $160+ per year to get an additional piece of ID. BUT if you travel with meds quite often, it can be a life-saver.

    As to your original question, is it possible for someone to find out that you have a MMJ recommendation? Of course it is. OBVIOUSLY. It's also not illegal for your employer to terminate you just for having a MMJ recommendation.

    And I can think of a number of legal methods whereby your patient status would become public knowledge. Just off the top of my head, if you ever have to appear in court to refute a ticket, right there that can show up on your background checks.

  7. A background check is different than medical records, right? Aren't medical records protected by HIPAA?

    1. Doctor's Recomendation (40-90$) (May or may not include a card)

    This gets you weed legally. Cops have every right to take your weed and not accept the papers until they can later confirm. However, usually this isn't the case, unless you're dealing with Mr. Conservative.
