    If a police officer was to pull you over and say that he had a suspicion that you were driving impaired, and asks you to get out of the car... which you do while rolling up all windows and locking your car... If he asks your permission to search the vehicle and he says no, does his suspicion entitle him to call for drug detecting canines?

    Let me just say to everyone..TAKE NO CHANCES! Avoid driving with bud if you are just rolling around. Only have bud on you when driving straight from where you are to where you will be smoking.

    Ive been searched for bullshit reasons before and they don't care what you say. This happened to me 4 days ago on my way to class. Was pulled over for throwing a cig out the window (like the rest of the world does) and was immediately told to get out of my car because I was "on the phone and moving around". Bullshit. anyway I was detained immediately and made to stand by the cops car in handcuffs while they tore my car apart. The whole time I was telling them how illegal it was and how I wanted my 4th, 5th, and 6th amendment rights and the whole spiel I usually give when cops give me shit to no avail. Luckily all that was in the car was my xanax script (which took me 10 minutes to prove it was mine even though my fucking name was on it. they ended up keeping it anyway) and they didnt find any bud (lucky because there just HAS to be some stems or shake in there). Cops told me to get out of there without giving me and paperwork or anything at all. Cops also stole all the money that was loose in my cupholder. They are fucking scum and will do whatever they want to so NEVER take any chances when driving with drugs.

    WHENEVER a LEO asks if he can search you, an item you are carrying, your car, whatever, you NEVER lose anything by saying "I do not consent to a search."

    An officer can pull you long enough to investigate his reason for the stop. So .. if he pulls you over for tail light, his time to invistigate is a very short on that. The mere suspicion at your refusal to allow search is not reason enough to detain you further to await a K9. He can write his ticket for tail light and let you go.. thats the approximate time he has to get a k9 there.

    Make sure to politely excuse yourself, asking to leave, because you have other affairs to attend to.. even if it means asking him to quickly give you your ticket. If he detains you further (obviously never physically resist or proceed), that aids in your defense. He will know that you have asked to leave and if he doesnt allow it, that is a considered detaining you .. and he will need cause for that to hold up. He has to justify why he detained you longer than reasonable to investigate and cite a a tail light (for example). That wont matter much if there is a K9 right there while he is writing out the ticket.

    As to being impaired, in CA, you do not have to consent to a sobriety test until you are arrested. Dunno about other places..



    On the negative side, cops have a lot of advantages in experience and ability to intimidate - and also this stuff is hard to fight if a cop just decides to do it anyway.

    just remember, if you act like a dick head to the cop he might execute his authority to detain you for 48 hours.
