Oregon law maker to introduce legalization law if prop 19 passes!

  1. sorry I cant get more info, but I was just listening to the news and I guess there is some legislator who will put forward a bill to legalize in oregon if prop 19 passes in californa!

  3. I am pretty sure it is going to pass and pretty sure it will be overturned shortly after like Gay marriage. I still think it is a good victory and I really hope what you are saying is true :hello:
     
  4. Not only that, but I'm sure the federal government would step in and sue Cali in order to stop the measure kind of like what they did with Arizona and immigration.
     
  5. Arizona wasn't sued, they were tried by the US government in a federal lawsuit, kinda like suing i guess but way more insane. But the difference is Prop 19 is not a Senate Bill, so the feds can't sue the state, due to the fact that the law would be based off public opinion and according to the 10th amendment of the US Const., states rights," providing that powers not granted to the federal government nor prohibited to the states by the Constitution of the United States are reserved to the states or the people." This is why medicinal marijuana is still around, they can fight it all they want through federal institutions and by stopping providing funds, but only we can repeal the law at the state level.
     

  6. Public initiatives can't get overturned for political reasons. They can only get overturned for constitutional reasons. Prop 8 was overturned because it was blatant discrimination, which is unconstitutional. Nothing about marijuana legalization goes against anything in the constitution as far as I know. The constitution was written to ensure freedom, not take it away. Prop 8 aimed to take away freedom while Prop 19 aims to add freedom. Through out history, you will not find many proposed laws that aimed to add freedom overturned for constitutional reasons.
