Alright well.. we had like 14 roaches right, and we broke them all up and rolled a blunt with them. Three of us were waiting around for others to come.. and it started getting dark so we were walking down the street to go to someones house. As we were walking a cop pulled up and turned around with a spotlight on us, and i was smoking a cigarette, and he was like "why are you smoking those they kill you" then he asked our ages and how far away we lived from there. And he started searching my friend. He found a white owl case with the blunt in it.. and he was like hmm is this a blunt.. and he opened it and was like.. yeah i thought so. Then he searched me.. luckily he didnt find my piece just yet. Then he searched the last person, nothing on him. My friend who had the blunt on him was put in the car.. and we were like no fuckin way, and then he came over to us and was like is it fair to say its all of yours or just his. And we admitted it was all of ours, so we all got into the car, went to the station. When we got there he searched us again, but this time he found my piece i had with me. So now he had a blunt and a piece from us. Then we were put into a fuckin cage, all three of us.. the cop was going thru our files and asking us our names again.. age.. shit like that, and under all of us he found another offense for theft. But anyway, after a while.. he was getting up and down talking to different people.. there was a crackhead down the hall so he had to go help keep her under control.. she was flipping out about the cop taking her money. The cop came back.. and sat on the computer.. then picked up the blunt and took it into the LOCKER ROOM. From what i know its supposed to go in the room marked CONFISCATION. Then when we were released he called our parents because we still live at home, and he told them we were running away.. and thats why he searched us.. even though he had no reason to search us.. we were walking down a street. Im curious.. isnt there a law on like reasonable cause or probable cause in NJ?
did you consent to a search? if he searched you without propable cause or your consent, it will most likely get thrown out in court.
If you're under 18, and out past curfew then that could maybe be grounds for 'running away'. And if you didn't say 'No, I do not consent to a search.' Before he searched you, then he can probably say he thought you consented... I would have most def. not let that cop touch me/search me at all. And why would ALL of you take the blame for that one blunt? The one guy is still going to get punished just as bad.
since your over 18... you have every right to leave your house so it impossible for you to be running away... i dont beleive your over 18, cause i have no idea why they would call your parents... and they released you in your parents custody?

If your under 18, Or whoever was smoking the cig, They have enough reason to search you. In court, Cop's would win the case. If your out past curfew under 18, Enough reason. If they jus so much as say they smell marijuana or any drug, Enough to search you under 18. Let it slide, And take it as a lesson learnt.
I don't think this is true.. I'm pretty sure this only applies to if you're in your car, and they smell weed. Like if you walk by they can't be like, hey I smell weed, I can search you now.. At least i'm pretty sure they can't anyways...
If you're under 18 they can do basically whatever they want. You're a minor, you have no rights. Get used to it until you become an adult.
Whenever I get pulled over or talked to by a cop in the street, I love saying "hey you can't search me" and they get so fucking pissed edit: hey, just because you're a minor doesn't mean you dont really have rights.. when I was like 16 i got stopped once with a witta quarter on me, and i told em they cant search me and they didnt. (it was only around 8:30, if it would have been later we coulda gotten fucked probly)
You're lucky the cop didn't give you a weed charge. Be happy with the positives. Sucks about the roach blunt, while harsh- they pack a resinated punch. And by the way, tobacco is whacko and gets people caught up like that if you're under age. Stick to good old mary jane.
Who are you givin people advice when you're a light weight just playin.. but yeah tobacco definately is a drug, and marijuana totally brings the effects into play. That must be why marijuanas legal cause if you mix with tobacco you get fucked up BLUNTS.

Hey, I'm just going to assume that you're not 18. Even if you do live w/ your parents, they're not going to hand you to them like that. I wish that were the case, I wouldnt have this damn charge. It's common sense that a cop won't search you for having a ciggerette unless you're under 18, making it illegal. When you do something illegal, they can search you. Just be grateful that you didn't get an actual charge. Peace. -Timmy
