Medical Marijuana Might Get A New Regulation

Medical marijuana may be winding up in the wrong hands and one lawmaker wants to do something about it.

Sen. Chris Romer on Sunday talked about a new regulation to make medical marijuana harder for young people to get. It's the latest of several attempts to regulate the growing industry.

This attempt by the legislature to regulate the medical marijuana industry is a long way from finished, but lately the pro-marijuana advocates have been winning some concessions at the Capitol.

Romer and Sen. Nancy Spence want to change the rules to get a medical marijuana patient card. He wants those who apply who are under 21 to get a second opinion before they can be issued their card.

"Every classroom I go in of high schoolers, when I speak to my own college students, I ask them, 'Do you know somebody under the age of 21 who has a medical marijuana card that is not chronically ill?' And every time I ask that question hands go up in the room," Romer said. "We know there is some risk here and today we're here to announce a proposed solution that would require that anyone under 21 â€¦ would have to get an evaluation by a substance abuse specialist."

Substance abuse counselors say they're seeing an increased caseload of young people whose brains are still being developed who are at risk with today's stronger strains of pot.

"Using marijuana as an adolescent can cause permanent problems later on in life. These include life-long psychoses, including schizophrenia, cognitive problems, memory problems. It's also associated with accidents, aggression, risky sexual behavior," Dr. Christian Thurstone with Denver General Hospital said.

The pro-marijuana forces have been winning some battles lately. Last week the House Judiciary Committee removed a provision that would have allowed local governments to ban dispensaries in their communities. They also voted to allow consumption of marijuana products on site at dispensaries. They also eliminated a cap on the number of patients a dispensary could serve, and they loosened the rules for criminal background checks that would have automatically disqualified someone from owning a dispensary.

That was just a committee vote. The lobbying continues and there will be at least a half-dozen more votes on the proposed regulations before anything is passed into law.

Denver attorney Rob Corry, who specializes in medical marijuana law, says putting age restrictions on young patients would be unconstitutional.

"The Constitution says if you're 18 or over all you need to do to be legal is get the advice of a single doctor, period, end of story," Corry.

Meantime applications to get on Colorado's medical marijuana registry have nearly quadrupled from a year ago. The state's health department says it gets about a 1,000 applications for medical marijuana per day.

The flood of people registering to legally use medical marijuana has led to a backlog of six months.

How do you guys feel about this? Personally, I think that it's a load of shit. As far as I'm concerned, all this is going to do is push these kids back to the black market, a lot closer to other, much nastier, drugs.

ITs a nonstarter if the constitution of CO states 18. Any stricter law would be dumped by CO's top court.
