So if you take a plea bargain to drop the felony charges and they charge you with a misdemeanor, can the charges ever be brought back? Like for instance, if you fail a drug test after you took the plea and the judge told you to stay clean and sober, could they put the felony back on or are you set with that misdemeanor? I'm under the understanding that I'm in the clear with the misdemeanor but what if you toke up after you take the plea bargain? Like you take the plea bargain to drop the felony, judge tells you to stay clean and sober for a year and stay arrest free, when you go back a year later after your unsupervised probation and fail a drug test....what happens? You just get more unsupervised probation? Is there any way that felony can come back?
I could be wrong but unless you are on actual probation they won't do anything unless you are arrested again. The judge is essentially saying fuck up again and were going to nail you but this is your first time stay clean.
once you get charged with a misdemeanor it stays....however you can still be charged with violated your probation which will be a whole new problem so id suggest just stay clean....smoke lots of cigarettes and spend time with your family
I mean I have a few months before I need to return so that's plenty of time to clean the system, I was just wondering what's the worst thing that could happen if I took the misdemeanor already and showed up with positive urine?
