Hi, about a month ago, I was going on my usual routine to buy a half oz. of some grandaddy purp from my friend. I was at a gas station near my house, where we had agreeed to meet. For a while, I was in the car waiting in the rear parking lot. The place was unusually packed, and it was a TUESDAY(I later learned that NARCS are always out and about tuesdays -.-) So, I walk around the cars into my friends car, we exchange money for bud, and thats it. It was a beautiful, great day, and we were about to hotbox the fuck out of that car. My friend (drug dealer) was infront of us driving, as we were both heading the same way after leaving the gas station. Two undercovers in dts/nissan altima pulled him over right infront of us, and before I had a chance to say anything or do anything, the door beside me opened, and I had a raging black underdocver cop lady screaming at me, asking me where the weed was.. Next thing I know, I'm in cuffs. My friend was punched twice in the face by the cop for no good reason, other than cursing after being told his car would be towed. I got out on bond, got an attorney, and I was charged with: (And I live in FL) Purchasing of Marijuana (Felony) Possesion of Marijuana (Misdemeanor) Possesion of Controlled Substances ( and this was dropped due to the pill being a half of a wellbutrin pill that I had, which was actually MINE, an antidepressant, reason for it being halfed was so that I could come off of it easier, as i had tried it out for a week and wanted to stop) Drug Paraphenelia (misdemeanor) So, my lawyer went to court for me, and he plead not guilty. He told me that my choices were either drug court for a year, probation for 6 months and the felony would stay on my record unless he could win (and I don't know how he can't? I mean, there is no actual proof of the purchase...) They have the exact written story of everything that happened, but how can that be proof of purchase? I chose drug court. I was told I'll be attending two NA meetings a week and being tested twice a week as well for drugs. More about me: I am a first time offender, I am 18 years old, I have a previous history from when I was 17 of being depressed, psychiatrists diagnosed me with bipolar disorder). You got royally fucked, that's a shitty situation for you both. Causing no harm to anyone except possibly each other. Guess he was being watched, or they were just staking out the place looking for deals to go down. They're pretty easy to spot lol. Two cars pull up, one guy gets in to the other, the same dude hops back out a minute later. Sketch as fuck I'm pretty sure you still can, that might change if you're CONVICTED for a felony.. but you'll be fine it won't get that bad. Edit: or the guy below me is right. Wow, this isn't remotely true. You have the option to get your record expunged at 18, but nothing expunges itself (bar special circumstances) As for OP, are you capable of staying clean for a year? Cause if you are, do the drug court. It's the better choice in the long run, assuming you don't fuck it up. I'd be willing to bet all charges but the Paraphernalia and Possession are gonna get dropped too. Also your friend might be undercover, that seems plausible.
Actually, my friend is in jail at the moment... And he has an EXTENSIVE criminal record. I should have mentioned that lol
Find and show me something that says it's expunged at 21. I'm not proud to admit it, but I've been in and out of the legal system since I was 16. I've had more than one lawyer, more than one public defender, more than one judge and everything I've ever been told by people who make a living in the judicial system contradicts what you're saying.
How will my records be expunged? Would it be because of me being a youthful offender? In any case, I don't think I'd wanna wait that long.. It's so hard to get a fuckin job around here, only choice really if i do that is to sell drugs..
why not ask the financial aid people on campus? or your lawyer. pretty sure if you get charged with all that shit, then you can't get financial aid. but hopefully i am wrong, it will depend on the outcome of the case most likely. best of luck OP.
Yes, you will receive a letter in the mail on, or shortly after your 21st birthday from the local police station stating to come pick up everything they have on file for you, and that your criminal record as a youthful offender has been expunged.
you have to pay a considerable about of money for your record to be expunged. if you are from florida or experienced in the florida court system it could be true. i know in my state if you get a misdemeanor, go to drug classes & pass drug testing then your first charge disappears. but OP isn't in my state & i have heard Florida is kinda hardcore on marijuana. Plus, Financial Aid isnt a state thing, its Federal.

No, just no. I don't know where you're from, but here in CA YOU have to do work to get your record expunged, nobody does it for you(bar certain circumstances, and if these pertained to you you'd know it). It costs money too. Second, you are a "youthful offender" until you turn 18, at which point you become an adult. From the ages 18-21 you are an adult. Third, why would they have you"come pick it up"? All the information about crimes you've committed is entered into virtual database and doesn't ever completely disappear. Try and work for the DEA or Secret Service. Just cause some cop at your municipal police department handed you the first ticket you ever got at age 16, doesn't mean it's completely disappeared. Government jobs with any amount of access to confidential info will do a thorough background check and question you about anything in your past. And as for all the people saying oh well if you do drug court/ complete probation they'll expunge it. With these things, basically what the judge is doing is suspending judgement on the case. Like they're basically giving you a chance to fix it, and you're gonna have another trial in a year, at which point if you've done everything required of you, they'll drop the case. It's called a "deferred judgement" and is completely different that getting your record expunged. Which you can do at 18. Also, nothing special happens at specifically 21. In most states you have to wait 5 years after being imprisoned/convicted and meet a bunch of other criteria before you can even APPLY to get it expunged.
Did you go to law school? Because if you did you have failed. Do some research, and stop starting arguments when you have no idea what your talking about. Your record is cleaned at both 18 and 21 unless the charges are outstanding (which they`re not), nobody said they cant still look it up if they want to...regardless of being expunged they can look up whatever they want. They have you pick up all the paperwork because they cant legally hold onto it once you turn 21 it becomes yours. Im done arguing with you, its pointless, you obviously have no knowledge in criminal justice, stop trying to act like you do.
Why in the hell would they clear your record twice? Once at 18 and again at 21! Makes no sense at all. Kinda like a second get out of jail free card!
No I didn't go to law school. Did you go to any form of school? I know exactly what I'm talking about and I'm not throwing out tidbits of quasi-correct information my girlfriend told me. The legal system isn't like that game "Telephone" we all played in elementary school- the information has to be 100% correct otherwise it has no meaning whatsoever. And once I turn 21 all legal information about me becomes mine? That's news to me. Are they any blades that are turning 21 in the near future who have a record? If so and if you'd be willing, I'd like you to go to the local police station on your 21st birthday and demand you give them all files regarding you. If they ask why tell them that "they are mine now because I turned 21". Then post back and let us know how hard the police laughed and/or the various insults to your intelligence they dealt out. And your juvenile record is cleared at 18. It is never again expunged that easily. For an adult, you can never get your record expunged entirely. You can get certain charges expunged, but you have to meet certain criteria, the most important of which is that 5 years have passed between your punishment and the time of your request for removing of charges. And you have to pay money too. Nobody just expunges your record willy-nilly like you made it sound like in your first post. I can only present the truth, I can't force you to believe it.
Ive been in and out of the system all my life, I still have MY letter from my 21st birthday and my records. 5 years!? lol, now your just making stuff up, even if your an adult you dont have to wait that long.
