Legalization and Incarceration

  1. Hello blades and bladies, I was just thinking about something. If cannabis gets legalized in California will all those who have been imprisoned on drug charges (Marijuana only) be released?

  3. Yeah I just got out of lock up on drug charges. I have 18 months probation and if I stay clean the entire time I'll get my charges expunged. But If i violate my probation (i.e. smoke weed, get arrested, etc. etc.) I have to do 2-7 years in state prison. Whether it gets legalized or not.
     
  4. It does suck, but the laws on the books are the laws. Even if they come off the books it's likely the argument would be that even if you disagreed with the law it was the law at the time and you broke it so your penalty will stand.

    I think the prop 19 and even all the MMJ laws would love to include some clause to get those already incarcerated out of jail, but I seriously doubt those propositions would have a chance at passing.
