Yesterday, my gardener had came by to mowed my lawn as usual. After he left I discover my main cola of Skywalker OG(in my screened and fenced backyard) had been snipped with sharp scissor. I'm thinking to contact the local police station for theft. The problem is my card expired few days ago but I has legit back problem (3 degenerated disc). Should I contact local police to report theft and press charges? I'm going to call the land lord to get the info of the gardening service.
It would be treated like any other plant IMO. My mom has gardeners and lawn care folks for her home, and they hit a really nice rose bush with their zero-turn mower, knocking it out of the ground. They paid for a new rose bush. I really doubt the police would treat this as a theft.
The law could care less about your medical problem. Calling the cops with a expired card classifys you as a illegal grower. Suck it up move on...not like you will ever get that bud back. Also if you did not see him do it then how can you be certain. You cant you have assumption and assumption to the law counts about as much as the lint in your belly button.

I wouldn't let a gardener (not that I would ever have or need one as I like growing my own plants of all types) near my plants ever ever ever. I wouldn't let my own child near them (they are all over 18 by the way) if they did not have a hand in growing them. You basically did not think straight and your learning a lesson about your own privacy and safety. Call the cops and see if they laugh at you. Legal or not your just asking for trouble in almost any county in this country right now. Unless the cops are all your cousins or something...
You don't need direct evidence to support a conviction. It is nice, and often there is a mix of direct and circumstantial evidence behind any conviction, but circumstantial can be enough. Here, the plant was seen (presumably) prior to the Gardener's arrival, and was intact. Sometime between when he arrived and shortly there after, the plant was cut with scissors. The gardener had the opportunity (was at the scene of the crime at or near the time it was committed), and had the tools to commit the crime. This is stupid, really, because unless you are crazy, this case would never be litigated in the courts, but the point is, circumstantial evidence can be sufficient to support charges. Finally, I imagine that the "case" would be tried in a civil court (conversion; trespass to chattels), where the burden of proof is by a preponderance of the evidence (more likely than not' >50%), and not the higher criminal BoP, which is beyond a reasonable doubt.

If you had a card, you might have a legit case if you could even remotely prove it was him. But since you don't you are an illegal grower, and can be charged with a felony if you're lucky. Even with a card, growing is only semi legal... But if you don't even have the state police on your side, well you kinda fucked up man. Fire the guy, and count your losses and move on. You have no case, unless you wanna try to settle with guy mano a mano. But they could just deny, because it really could have been anyone. And anyone who steals will be likely to lie anyways.

Losing a client can cost money lol.... think about how much you pay them annually and subtract the quantity of weed stolen... thats how much you can remove from their wallets. Sure you could get the law involved.... but this dude clipped a plant in your yard, i do understand the concept and morals (or lack there of) behind theft... but consider that they could have cut your entire crop down and since you technically have no med card, there wouldnt be shit you could do about it. you deserve to get jacked if your dumb enough to neglect your crop while your gardener is mowing your lawn I mean they are there the same time every week right same day atleast, so you should have know to be home...honestly you shouldn't even have people around or near your spot. i stay posted from mid august to November don't leave for a damn thing, i don't even shave, shit there and watch my crop, by the time I chop it im so sick of looking at all that shit, you were probably off at your buddies house smoking while your shit was getting snipped ...and all bad to call the cops with an expired card they are gonna wax you and you will get arrested most likely
IF it was your gardener that cut your cola then he knows you grow. Does he have other workers? Fire him and you can possibly, loose the rest of your plant(s), or get reported too the police. Don't fire him, instead, have a discussion that something is missing from your yard. You did not see him take it but you noticed that it was missing after he was there. Study his body language too get a feel if he is involved. It could be a neighbor as well.
I had to have a plumber come to clean a drain at my house. I made a huge fake clothes line, and hung up all my cal. king sheets to block the view of my garden. Personally if it was me I would confront the gardener, he will deny it. Tell him point blank you wont be needing him anymore.
I personally wouldnt involve the cops, they arent going to work at getting you bud lol. If you choose to grow outdoors dont do it in a high traffic area.. by the sounds of it not even being your personal property and growing it in plain view of your lawn you were bending over asking for it. Move out buy your own place and do it indoors under lock and key.. Better under lock and key then to leave to those who thieve..lol
