So over the weekend my buddy and I got caught drinking under age, we gave up the alcohol that was LOCKED in the glove box along with my bowl, grinder, and small stash jar of 2gs. The cops found it, but when questioning me, I denied to know whose it was. I was never legally a passenger in the car, so I got written a Minor in Possession of Alcohol along with my buddy, but he also got charged for the Possession of Marijuana. (The cops never took the bowl off the car seat ). But my buddy wants me to take full responsibility for the Marijuana. Since he has already been cited for it, and it was LOCKED in his glove box, even if I did say it was mine. Would they charge us both? I'm going to get clean for court even though I know I won't have to drop at my Arraignment, if it was to come up later then I will be set. If all of this would have taken place in my car, then I would take full responsibility for everything. What advice do I have from my fellow stoners?
MY bowl, grinder, and small stash jar of 2gs.
If it was yours you should have been a better friend and claimed it in the first place. Even if you an him both got charged it would be better than just him. I'd be pissed if I was him. I've been in a similar situation before and claimed it simply because it was indeed mine even though we were both smoking. I got charged and he didn't. That's the way it should be.
well here is a way you can both be bros about it. 1 you split the charges, he takes the alco and you take the weed. fair trade 2 if it was really your weed, man up and take the charge for a young person in michigan as a first offense they will only give you a fine and maybe some probation for like a year, not a big deal. if you come clean on it, it will look good to the judge that you are a reasonably responsible person who is accountable for his actions and that may go easier for you, so long as you try and say something to that affect in your statement to the judge. 3 if you both were drinking and they breathed you and got you fair and square, then you have to take both charges, but depending on whose bud it was they should take the charge on it. no sense in letting the system win twice at something they shouldnt have won at all.
We both got PBT'd, so I can't really split the alcohol charge. But then again, I don't feel as if I should have to take all of Marijuana charge because he smokes with me all the time, and some of the bud in there was purchased with his money.
You'll both definitely be charged. It's his car, his responsibility for what's in it. (Legally) just tell him to man up and take the charges. No point in both of you getting charged. Unless it was all your weed, bowl, etc. then I would admit to it anyways
There should be a general unspoken rule of thumb that whoever's bud it is should take responsibility. ESPECIALLY, if its in their car. However, if the cops find it the person who is asked first should own up to it (if its mutually owned). I would never put a buddy of mine out to dry like that.
If you guys made an agreement like that let him take the charge. As if they already charged him and you stand up for it theyll charge BOTH of you. If anything get clean. Avoid additional charges. And be chill at court some people said you'll just get probation or whatever but you never know. Sometimes you get a dick judge that hates stoners.seriously
Exactly, when the Cop asked him if he smoked before the game he said YES. If he had said no, then I could take full blame and he would just get the Minor in Possession of Alcohol. If I tried to take the blame for it now, then they would charge both of us unconditionally.
Honestly it sounds bad but i wouldn't fess up. Legally he is liable as it was under his possession at the time and not yours. You admitting it's yours won't get him off it will just take you down with him and can fuck up your chances at financial aid for school n such.

So listen to this ^ and what I said. Or take probation and no smoking for months or some shit no skin of my nuts
Agreed, this is all I can think about and it makes my stomach hurt. I want to do the Honorable thing, but all the evidence points to him and he already dug himself in a situation that he can't get out of. Fuck the legal system, getting my card after all this is done.

First thing first did the police ask and get a verbal ok from the car owner to search the car? If not that is an illigal search and will be thrown from court! Even though they had prob cause if he refused the police would call a judge and get search warrent at that time.
Unfortunately, we are both 18. But we were on school property, so the administrators were able to search the car with cause; which happened to be "us smelling like alcohol", but I asked several people around me afterwards, and they said that we did not smell of alcohol or smoke, or were not acting funny. Someone ratted us out.
Last I checked, I didn't see "Moderator" or "Administrator" underneath your username, I'm 18 and haven't broken any rules. Yes, unfortunately i'm in my senior year of high school.
