just busted..

    its 3 am and i just got back from the police station on charges of "criminal possession of marijuana"
    i was in the park at the dead-end of my friends street, cop rolls up, walks up (not driving) i throw my scale and my bowl underneath the table and the cop sees it. My friend (kinda) starts bugging out because he thinks that the cop is gonna suspect that the items were his, so i admit that they were mine. The cop didn't read my my rights and the park is a private park (my friend lives on the road so hes entitled to use it) I got bailed out at $250..

    Funny things that happened, though, the cop opened up the bag of weed and it stunk up the whole area i was in.
    I picked my nose and wiped it on the glass
    My friends were makin noise on my 2way on my phone most of the time and the cops were buggin out lol


    Anyways, should I be alright in court or should i be ready for a hard sentence??

    how much did they get, was it in one bag, are under 18 ,is this your first criminal charge, thats what i need to know man tell me

    over an O - felony (at least in california, dunno where you are Ryax)

    more than one bag - posession with intent to sell

    over 18 - charged as an adult, very possibly harsher sentence

    more than one criminal charge - harsher sentence, longer probation/parole

    There's a drop down box in the left menu... Select your state and it'll tell you the laws for your state... You can then plug in your info (how much you had, how many bags, etc.) and get a decent idea of what to expect. If it's your first offence, you'll probably only get probation... This depends on whether or not you had a felony amount of MJ or not though, and whether they're gonna get you for intent to distribute.

    My best advice would be to get a lawyer (or public defendant if you can't afford one) and don't answer any questions until then. Also, make it clear that you weren't read your rights. Do you have a witness that can testify that you weren't read your rights? If so, legally, they're supposed to dismiss the case. It's the law that they have to read 'em, and if they don't they don't have a case. Gotta love the loop-holes and technicalities sometimes :)

    Move to canada, i've been pulled over, 'talked to', driven home, but NEVER arrested,even with dope on me, even with a lit joint.

    United States marijuana laws suck.

    totally agree with you there dude...whats the fucking point when most people do it when all else fails.

    Bet you any money a good portion of the older once 'upstanding people of the community' found solice in herb out of all the prescribed shit the money grubbing doctors put 'em on.

    i'm pretty sure if its your first offense, and had less then 50 grams, you just get a year of probatinon, then they erase the possesion off your record

    My case is going to be great
    I have the deeds to my friends house from like the 1800s that state that the beach that i was at IS private property and was formerly owned by them and that they do partially own the beach (rather than the town). Also, the cops arent supposed to come down there unless the cops are called, and the cop didn't read me my rights or make me sign the memorandum (sp) document.

    In additon, it turns out he has been following young girls home
    and also got caught red-handed fucking a 16 year old girl...
    but thats another court case >:D

    if they didn't read you your rights, and you have a good lawyer, you may be able to beat the wrap, but it's hard..

    actually ... being read your rights or not has no bearing on the case... its a myth and ppl cant stop repeating that. ive heard from lawyers/cops/read from books/teachers

    if they don't read you your rights, they can't use anything you SAY against you - but they can use physical evidence. in this case, the rights won't be what saves you, but them being in an area they shouldn't be without probable cause might. best of luck to you.

    the private property thing has nothing to do w/ it since u threw it into plain view. if it wasn't visable and he did an illegal search thats another thing. ur rights are only for what you say after yur caught, not what physically happened before.. next time keep it in your pocket, say hey to the cop and he'll leave, if he doesnt kindly explain your on private property going for a little walk about you dont want to be bothered... dont throw it infront of his face durrrrrrrrrrr

    Your miranda rights dont' mean shit unless you're being interrogated. Well thats how it is in Illinois, anyway.

    well i dunno about the US, but in Canada, your rights are worth something.. i know a guy whose friend got off a speeding ticket in court because the cop wasn't wearing his hat (part of his uniform).. believe that..

    Its a little bit different in my town... the cops know everyone, and every (new) person to my town they wanna know what their deal is. The other night i was at 7-11 and the K-9 unit rolled up and just walks over to my friend and pats him down for no reason. Sorry if cops arent crooked where you are, but they are here.

    Just thinking about her back in the day (14+ by canadian law) hitting a nice j brings around tent pitchin' troops in no time. lol

    Btw am I the only one who's sorta ticked Emma Watson isn't Candian? A trade off of sorts as in the UK you can pose nude with parents permission at 16 or some shit. Theres a site fulla crazy laws can't recall the name but look for it as it's funny as hell.
