Illegal or Not

    Say you were riding in your friends car down the highway at about 10mph over the speed limit. You get pulled over by the police, and your idiot friend consents to a search when asked by the cop. In the car however, you have a backpack. While the police is searching the car, do they have the right to search the backpack considering it isn't the drivers things? Note, there is no probable cause. The friend just consents because he is an idiot.

    If you weren't smoking anything and you were simply pulled over for speeding I don't see why the cop would even ASK to search your car. If your friend did consent to a search then I would say that yes, he does have the right to search everything inside of the car unless it is locked or something. And if he doesn't have a right to search the backpack, he'd probably just open it and start rummaging around anyway, I mean he's already in the car, while you are not in the car.
    In this case I would suggest taking your backpack out when you got out of the car, and wearing it. If he asks just say it's a habit. If he asks to search your backpack, and you obviously are not one to consent to searches then just say no. But either way really you're fucked.

    But really:
    Don't go ten miles over the speed limit if you have a backpack full of weed in your whip.

    Probably not legal, probably doesn't matter. Depends on whether your judge believes in the Fourth Amendment; most don't.

    Why is your friend an idiot for consenting to the search?

    If he doesn't the cop could call a K-9 and really fuck you over

    he cant search your car, without probable cause....hahahahha so there would be some sort of cause, that probably made him want to search you.

    like sirsog said, they must have a cause to search your car. If you give them consent they have the right to search EVERYTHING that is in the car. your friend should have asked why? before he gave them consent. but if i had weed or paraphernalia on me i'd be going 5 over at most....soooo your friends a knob

    If he consents then yes, the cops can search EVERYTHING in the car, including your backpack.
