If I get caught with weed can I argue it's for medicinal purposes?

  1. Okay, so here's the deal. I'm uh, 18. In high school, and I have Tourettes syndrome. Had it since I was a kid, and in the process of diagnosis. And I was wondering, since there have been studies that suggest it helps with this disorder, even though I live in a state that has no medicinal marijuana laws. Can I (once I get diagnosed) argue that it's for medicinal purposes if I get caught with it? And will that lessen or eliminate the punishment or will it make no difference at all?
     
  2. probably no difference at all, especially if you're in a non-mmj state. cops dont give a fuck what it's for, they will see it as a DANGEROUS NARCOTIC
     
  3. Some states strictly prohibit is no matter what.

    Some states prohibit it, but allow what's called, (i think), an affirmative defense, which means that you are at least given a chance to show a medical need and that the judge is given discretion as to whether to consider it a mitigating circumstance, in which case he might give you a lighter sentence.

    But to answer your question, probably not, even if you're in a state that allows an affirmative defense.

    Oct. 6, 2006 -- THC, the key compound in marijuana, may also be the key to new drugs for Alzheimer's disease.

    That's because the marijuana compound blocks the formation of brain-clogging Alzheimer's plaques better than current Alzheimer's drugs.

    The finding -- in test-tube studies -- comes from the lab of Kim Janda, PhD, director of the Worm Institute of Research and Medicine at Scripps Research Institute.

    "While we are certainly not advocating the use of illegal drugs, these findings offer convincing evidence that THC possesses remarkable inhibitory qualities, especially when compared to [Alzheimer's drugs] currently available to patients," Janda says in a news release.

    "Although our study is far from final, it does show that there is a previously unrecognized molecular mechanism through which THC may directly affect the progression of Alzheimer's disease."

    Janda's team found that THC blocks an enzyme called acetylcholinesterase, which speeds the formation of amyloid plaque in the brains of people with Alzheimer's disease.


    The Alzheimer's drugs Aricept and Cognex work by blocking acetylcholinesterase. When tested at double the concentration of THC, Aricept blocked plaque formation only 22% as well as THC, and Cognex blocked plaque formation only 7% as well as THC.

    "THC and its analogs may provide an improved [treatment for] both the symptoms and progression of Alzheimer's disease," the researchers conclude.

    So what exactly are we being "protected from" here? The possible cure for Alzheimer's?

    Shoot in az (a new mmj state) if you are not a card holder and you get caught with even a roach, seed, stem it is a felony

    Best bet move to a state where it is ok. I know. You can be 18 for az mmj
     
  6. Probably will not help especially in a non MMJ state but it really depends on the cop that catches you.
    Pretty much best case scenario he feels for you and takes all the shit from you, lets you go though
     


  7. I doubt this to happen these days. In the bad economy police dept are run just like a big company = budget cuts, lay offs and super high expections of the fewer cops to show the less police dosnt make a dif in productivty of law enforcement.
    That is my view atleased..

  11. I can say "uh" all day long, but if the moderators on this site are professional in any way, they'd acknowledge, despite what the "uh" might suggest, that I said plain and clear that I'm 18.

    And thanks Granny, your list is super helpful. I wish I could just email a congressman or something instead of mailing, because if I get a letter back in my parents mailbox regarding marijuana, I'll most likely be fucked.
