Dude, that's fucked up, glad I got into smoking in college and not in high school. If anything, I'd say the moral of the story is: CHOOSE YOUR SMOKING BUDS WISELY!

something similar happened to my friend he has gotten caught several times before and has a suspended license until 18, has to go to drug abuse classes or whatever they're called, has to check with his parole office (they give him a heads up every month) but in our town almost everyone tokes (even some teachers are known as regulars in the circle) so they only have have two days at the end of april and may when they do searches and most of the time there the same days as the past years. One he almost got caught this year with some of my shit but i guess they didn't find it cuz he hid it in one of his books, but they tore his locker apart and there were scratches all over his locker..... i was freaking out the whole time in my spanish class i thought he was going to get caught for sure

Now my administrator is telling me that I'm in all this major trouble and that my cooporation will determine what my punishment would be. He wanted names of the major drug dealers in the school. I'm like "look, i'm not ratting anybody out. that's wrong." (even though someone did that shit to me; if/when I find out who they are they are in for the ass kicking of a lifetime; I'm talking about serious shit going down like putting their bitch ass in the motherfucking hospital.) After they were done searching the car they take me back to the office. Since I've never been in any trouble before they only gave me a 5 day suspension out of school, plus I got to go to ACE (drug counseling class which costs $400...damn, I could buy a lot of weed with $400.) The contraband was also turned over to the school resource officer, and he wrote me a citiation for 2 misdemeanors (possession of less than 1/2 oz and drug paraphenelia.) So I have to go to court too. For those of you who don't know, the supreeme court case, TLO vs NJ established the prescident that allows the schools to conduct searches w/o warrants or probable cause as long as they have "reasonable cause" (whatever the fuck that means) However, since the contraband was obtained w/o a warrant or probable cause, I think that there is a good chance I might be able to get the charge dismissed under the court's jurisdiction, since courts are different than school. Also one of my close friends got busted too. He was also identified as a student who might have drugs so they searched him and they did not find anything illegal. They did find a pill bottle that contained about 70 tripple C's. Because of that they suspended him for 5 days and are making him go to ACE as well. They suspended him for the possession of a fucking Over the Counter medication. To what end will this oppression go!!! So I say fuck the wake co public school system, fuck the school administration, fuck the police, fuck the school security and fuck the horse they all rode in on! Fight the power, I sure as hell will!

Now, to clear up New Jersey vs TLO. The supreme court DID NOT rule that they can search your shit with consent, they just need a lot LESS probable cause in order to search you/your things. This is because they see drugs and all that as interfering with other students education... (I'm not sure what the boundaries are on your car, I'm pretty sure the same rule applies but I could be wrong). If they told you that, theyre bullshitting. The most they can do if they think you have something is look through your things real quick and if they dont find anything, the search should end.

Basically man, you got FUCKED. Really bad. But dont worry, me and my friends got fucked over pretty bad too. God damn off duty cops with their random ass park-walks and their god damn k-9 pups!

Yeah but for real are you in Wake County, NC? I live in Holly Springs..

Dude shit man that sucks, but as far as I know, they have a right to search your locker, but you can argue that a clean body search, and another students opinion is not a reasonable cause for an unwarrented car search, talk to a lawyer for sure, I'm pretty damn sure they had no right to search your car man. good luck.

In December 1965, Des Moines, Iowa residents John Tinker (15 years old) and Mary Beth Tinker (13 years old) and their friend Christopher Eckhardt (16 years old) decided to wear black armbands with the peace sign on them to their schools (high school for John and Christopher, junior high for Mary Beth) in protest of the Vietnam War. The school board apparently heard rumor of this and chose to pass a policy banning the wearing of armbands to school. Violating students would be suspended and allowed to return to school after agreeing to comply with the policy. Mary Beth Tinker and Christopher Eckhardt chose to violate this policy, and the next day John Tinker also did so. All were suspended from school until after January 1, 1966, when their protest had been scheduled to end

A suit was not filed until after the Iowa Civil Liberties Union approached their family, and the ICLU agreed to help the family with the lawsuit. Their parents, in turn, filed suit in U.S. District Court, which upheld the decision of the Des Moines school board. A tie vote in the U.S. Court of Appeals for the 8th Circuit meant that the U.S. District Court's decision continued to stand, and forced the Tinkers and Eckhardts to appeal to the Supreme Court directly. The case was argued before the court on November 12, 1968.

The court's 7 to 2 decision was handed down on February 24, 1969. It held that the First Amendment applied to public schools, and that administrators would have to demonstrate constitutionally valid reasons for any specific regulation of speech in the classroom. Justice Abe Fortas wrote the majority opinion, holding that the speech regulation at issue in Tinker was "based upon an urgent wish to avoid the controversy which might result from the expression, even by the silent symbol of armbands, of opposition to this Nation's part in the conflagration in Vietnam," and, finding that the actions of the Tinkers in wearing armbands did not cause disruption, held that their activity represented constitutionally protected symbolic speech.

Justices Hugo Black and John Marshall Harlan II dissented. Black, who had long believed that disruptive "symbolic speech" was not constitutionally protected, wrote "While I have always believed that under the First and Fourteenth Amendments neither the State nor the Federal Government has any authority to regulate or censor the content of speech, I have never believed that any person has a right to give speeches or engage in demonstrations where he pleases and when he pleases." Black argued that the Tinkers' behavior was indeed disruptive and declared, "I repeat that if the time has come when pupils of state-supported schools, kindergartens, grammar schools, or high schools, can defy and flout orders of school officials to keep their minds on their own schoolwork, it is the beginning of a new revolutionary era of permissiveness in this country fostered by the judiciary."

Harlan dissented on the grounds that he "[found] nothing in this record which impugns the good faith of respondents in promulgating the armband regulation."

Tinker remains a viable and frequently-cited Court precedent, though subsequent Court decisions have determined limitations on the scope of student free speech rights. In Bethel School District v. Fraser, a 1986 case, the Supreme Court held that a high school student's sexual innuendoâ€“laden speech during a student assembly was not constitutionally protected. Fraser qualified Tinker in making an exception for "indecent" speech. Hazelwood v. Kuhlmeier, where the court ruled that schools have the right to regulate, for legitimate educational reasons, the content of non-forum, school-sponsored newspapers, also limits Tinker's application. The Court in Hazelwood clarified that both Fraser and Hazelwood were decided under the doctrine of Perry Education Association v. Perry Local Educators Association. Such a distinction keeps undisturbed the Material Disruption doctrine of Tinker, while deciding certain student free speech cases under the Nonpublic Forum doctrine of Perry. In Morse v. Frederick, the Court held that schools may, consistent with the First Amendment, restrict student speech at a school-sponsored event, even those events occurring off school grounds, when that speech is reasonably viewed as promoting illegal drug use.

In 2000, in the AlBaho Case, a French criminal court found three senior academics at the Ã‰cole SupÃ©rieure de Physique et de Chimie Industrielles de la Ville de Paris (ESPCI), guilty of email espionage on a graduate (doctoral) student. The ruling set an important precedent in e-mail privacy but it was also a landmark ruling in student rights since this was the only known incident where academic staff where found guilty of a criminal act as a result of a complaint made by a student - and where those staff members had the full support of their institution.

The Morse v. Frederick trial was a First Amendment student free speech case argued before the Supreme Court of the United States on March 19, 2007. The case involves Joseph Frederick, a then 18-year-old high school senior in Juneau, Alaska, now 24, who was suspended for 10 days after displaying a "Bong Hits 4 Jesus" banner across the street from his high school during the Winter Olympics Torch Relay in 2002.[1]

In future, park off school grounds. I don't have a car, but that's something I tell all my friends, because if youre off school grounds, and they search your car, they are violating your constitutional rights, and you can legally rape them pretty much, but if they do it on school grounds... well doesnt that suck?
