How/Why do feds shut down dispensaries.

  1. Im not in the USA, i have a question, how do feds shut down dispensaries in cali if its legal for medical use?
     
  2. well i mean lots of legitimant businesses get shut down, same goes for dispensaries
     
  3. well, there is the federal government which is like an umbrella government. Then each state has the right to vote on its own laws... but federal law over rides all law...

    So, when a state votes to legalize mmj, or mj in general. The local police no longer have any power over the situation, but federal agents do...
     
  4. i'm from a uk sort of understand it..but lets say every single state legalized weed and every state had 100s maybe 1000s of pot shops, it would be out of their control?

    They don't have the money or man power to fight it as it is now lol

    Hence we are winning their war on drugs hahaahah

  7. At that point the DEA would most likely be overwhelmed as that would be a ridiculous amount of dispensaries to storm and close down. At the present time though, the situation is on the state level only a few states have started to decriminalize and/or legalize marijuana, so the job of shutting down these dispensaries is still fairly feasible. Federally, marijuana is still very much illegal and will probably stay classified that way until the DEA literally gets over whelmed.

    That said, it does appear that the winds of change are blowing, so it's going to be very interesting to see what the future holds.

  13. Federal government (The entire USA) Marijuana is ILLEGAL in ALL forms.

    When states pass their own laws, for medicinal, or now recreational use, they are going against federal law.

    And that's when the DEA kicks in your door.
     
  14. The federal (national) government is above the state government, so anything the state says can be overridden by the federal government.

    Thats why medical marijuana is such a big issue, because the state says yes, but the federal government says no.

    We are asked to elect local officials based on policies and community views
    but that kinda defeats the whole purpose when big brother just takes over whenever he feels like it
    the state gets overruled in its own territory

  17. I think the OP might be looking for a little bit more specific info.

    Like, How do they target the dispensaries that end up getting shut down (that run within rules, ie not within 1000 yards of a school, not breaking any state regulations)? High-profit shops? Ones in busy areas? Or random? Someone calls in with an anonymous tip? We know federally they have the "authoritaaay" to shut any of them down, but how do they pick

    LOL! That cracked me up man. That'd be so funny, the high up (pun intended) DEA guys saying, aw shit we're outta that dank stuff, we need to raid some more Cali dispensaries. Hahaha if that scandal ever came out I would die of laughter
     
  19. Realistically its already way out of the Federal Government's control but I'd bet you a fiver they'd still try and enforce it. Partly because of political pressure, partly because their law legitimately takes precedence over state power and they won't want to lose face.
     
  20. Dem-Socialist here, this is the product of our delicious federalist system. We can have two sets of law in one area, thus causing jeopardy no matter what. And it is a war on freedoms, the freedoms to chose what you do with yourself, affecting yourself, marijuana, all drugs really, abortion, marriage, these do not affect others but are still taken away from us, they are our damn rights people, our rights as humans! And our taxes go towards prosecuting and stealing these freedom, and making war, while ignoring the unhealthy, poor, and disadvantaged. My hope is that a) a supreme court cases comes forth, sets precedent as marijuana being legal for rec. use at fed level 2) Executive order issued, ceasing all prosecution or execution of the current laws, effectively legalizing it. Both good and possible.
