How a $100 fine in Ca costs you $500...

    I would like to explain a little of how California laws says a fine is one thing, but you really pay another. The tax on the tax. The dastardly "Criminals" in CA do not have a very good lobby so every time the govt needs a new tax, they add it on to fines. Other types of taxes are not accepted by the people, but certainly a few fees on a fine never hurt...

    An example of this is often found when people erroneously claim that the fine for possession of MJ under an oz in CA is a $100 fine. That is false. That is a lie told to you. It ranges from $400 to over $500 depending on how it is enforced.

    The reason it is often misunderstood is because the law actually says this charge is a $100 fine

    You guessed it, some how that makes people think the fine for under an ounce is a $100.



    The California legislature has invented a virtually unregulated body of highly paid bureaucrats making six digit salaries and their primary purposes is to ensure the courts are evenly taxing everyone ridiculously.. but evenly *cough cough fairly ..

    This body is the Administrative Office of the Courts and they have provided, to all courts, the handy dandy Uniform Bail Schedule.

    If you read there they will talk about surcharges and penalties you will see the following:

    Then courts will tack on their own fees like Senate Bill 1407 tacks on 35 for an infraction and 30 for a misd or a felony. Yes, a felony is cheaper than an infraction. Why? People who get infractions actually pay their fines so they get a little more tax as a reward.

    Then add on victim restitution, which you pay even if there was no victim, per PC1214.1.. and that is a $100 minimum.

    So $100 fine, plus bs MINIMUM codified assessments equals $380.. to begin with..

    Plus Restitution for your victimless crime of smoking a joint $100
    Plus a court fee of $30.
    Equals $510.

    Do you have that on hand? No, you need payments. The court will gladly grant you payments, for a fee of $30.

    SO there you have it boys and girls... how a fine of $100 for smoking a joint in Ca can really cost $540.

    OR MORE.. depending on your judge.

    The madness needs to end.

    Well, you get a warning as well if it's one of your first 3 times. But it doesn't cost anything. Even though we're one of the most backward countries in Europe with our drug policy. And people praise Cali for it's MJ laws...
     
  3. CA fines, puts in jail and prison many tens of thousands of people over MJ. For example: A very common way for people to go back to prison/jail is to test positive for MJ for parole/probation. .. I doubt there is anyone praising CA's mj laws. Every thing we have was ripped away (and they are still kicking and screaming) from our gutless bought dirty politicians and voted on and demanded by the people. Anything good here the people people have fought for and demanded. Right now, thats a lot of med mj. :smoking: Everything they still have control of or they steal is just as fucked up as anywhere else. November were taking more from those thieves.

    thats why im a legal mmj patient in cali now, although in 10 years of smoking weed i've never been busted for it
     

  5. More than that, I can see that bill getting the ball rolling for not only federal legalization but legalization in much of the western world.

  6. that's what I'm hoping for. I know that as soon as California or maybe even another big state legalizes it, the rest of the US will follow, and hopefully other western countries.

    I normally don't vote but I will definitely vote this November. This initiative has the potential to start the domino effect and I want to say I voted on it :)
     
  7. You can bet 5 states: CA WA OR NV and CO will have full legalization was well as 5-6++ more MMJ states within the next 4 years..

    The days of federal prohibition are numbered.
