Help out my little brother with possesion charge

  1. my 17 yearold brother got a ticket today for possesion, a 221.05 penal whatever the fuck, and neither of us know how to deal with it.i have a bunch of questions and he really doesnt want our mom to know cause she'll take his car away and he just got it tuesday. 1, will they send letters home that out parents will see and if so when should they get here, 2, how much will the fine/court costs/everything end up costing, 3, does he just go into court and hand them cash, 4, since this is only a violation is this gonna come back and bite him and our parents in the *** when i'm trying to get loans to get into college, and 5 should he tell our mom? thanks alot everyone we need help and support, tell me your stories with the cops and how you delt with the ticket

  4. basically, hes 17. he will go on probation for 6-12 months, matters if he got caught with a gram or 27G and lower. have piss tests til hes off probation, if he fails one, his probation will go on longer, so no more weed for awhile ide say, but you are expected to fail your first one, so have fun until then. no court costs unless you fight the charge(pleade innocent)
     
  5. § 221.05 Unlawful possession of marihuana.
    A person is guilty of unlawful possession of marihuana when he
    knowingly and unlawfully possesses marihuana.
    Unlawful possession of marihuana is a violation punishable only by a
    fine of not more than one hundred dollars. However, where the defendant
    has previously been convicted of an offense defined in this article or
    article 220 of this chapter, committed within the three years
    immediately preceding such violation, it shall be punishable (a) only by
    a fine of not more than two hundred dollars, if the defendant was
    previously convicted of one such offense committed during such period,
    and (b) by a fine of not more than two hundred fifty dollars or a term
    of imprisonment not in excess of fifteen days or both, if the defendant
    was previously convicted of two such offenses committed during such
    period.
    your brother is looking at a 100$ fine. I doubt mail will come for him but make sure you take care of the court dates in a timley manner and CHECK the mail everyday you can before your parents get ahold. If he would have went to jail and was bonded out by you and your parents didnt know, they would have been sent mail by lawyers and attorneys like my parents got. His charges will not affect anyone but himself, and quiet possibly if he stays out of trouble until hes 18/21 he may be eligible to get the charge expunged (removed off his record). Take this as a lesson to the both of you and your friends... I hope your parents dont find out! Good Luck!
     
  6. It's sad that I know that's the New York penal code for unlawful possession of marijuana, it's only a violation he'll be fine. Back when I was 16 and 17 I got arrested a few times without my mom knowing. He'll either get a ticket which will be $100 with another with another ~$125 tacked on for a surcharge. That or he'll get a six month ACD, adjourned contemplated dismissal, which is basically nothing, just don't fuck up and your record will be clean in six months.


    Fuck me I've been through this way too many times.

  18. Hmmm, that sure looks like hes asking if it will affect HIM when op is trying to get a loan? Unless of course him referring to himself as "i'm" does not mean him then I dont understand the bolded part. Could you please explain?
