Help me - Ticket!!

    So tonight I was havin a few people over while my parents are gone. The max was 10. We are all 18 by the way. Anyways, we're drinking and toking, some
    Of us on the back deck. The cop comes and said there was a noise complaint, I said ok he gave me a warning and left. I went out back and told
    Everyone to be quiet while reminding them constantly. I went to bed, and was woke up by my friend, the cop was back. I answer the door, groggy from
    Bed and he already has my ticket written. He tells me that the party has to end and I explain to him that there are only 6 people, and 2 on the back deck, smoking cigarettes, which was all at that time. He hands me the ticket, and I ask for his identification, as I plan to dispute it. This angers him, and suddenly he accuses me of supplying minors with alcohol. at this point he walks into the door, where I make it clear that I don't consent to any searches unless he has a warrant, and he threatens me with obstruction of justice charges as he storms through my house, saying he doesn't need a warrant because I'm a minor. He finds a bag of weed and accuses me of smoking, which I denied. He then informs me that if I dispute the ticket, the weed will come up.

    So, should I dispute the 500$ noise fine? Can I get fined for weed that was on my counter if I was sleeping and it wasn't even mine? Can I get a fine after the fact for weed, like if it was brought up in court? I feel as if my rights were extremely violated. Any advice would be appreciated, hopefully this makes sense.


    I live in Canada by the way.


    Tl;dl: Read it, it's exciting, has cops, drugs and all that cool stuff in it and I REALLY need some advice.

  3. I would of just killed him when you had the chance.. if it was your weed you might want to just buy the 500 but if its a mate or something get them to take the fall and dispute the noise fine
     
  4. That cops sounds like an asshole. At what age are you legally an adult in Canada?
     

  5. Wasn't my weed, was a buddies bag. What's funny is the first time the door bell rang, I went and grabbed a 12 inch knife and had it in my hand before I realized it was a cop.

  8. I'm pretty sure he'll say he has probable cause, to which your unlawful entry dispute is null.

    But $500 for a noise complaint? Damn, son

  10. well are you a minor or not? if not, then the cop incorrectly used his judgment to force a search, therefore rendering the weed evidence null and void and you can counter sue his ass.

    • weed is null as evidence as soon as he failed to charge anyone with it.
      • evidence found during an illegal search is null.
        • minor or not answering the door of a private residence, the cop had no right to enter and was told so.
          • Doing so AFTER being asked for his ID info is evidence of retaliation and would support such an implied aspect he is lying about the pot if brought up, as another retaliation move....
            • mention the cop slapped at his gun as he forced his way inside after getting pissed over you asking for his ID... implying threats with 'or else' as he shoved you into the home in a rampage [​IMG]
    • who complained each time should be demanded as evidence and those people subpenaed as witnesses.
      • no accusers indicates another motive/reason of the cop that you have shown to be less than honest.

  13. OP- everything you did to mitigate (telling people to shut up- being calm and polite with the cop while explaining there were only 8pple etc) was GREAT!

    Though if a cop starts up with the BS noise violation/party disorderly conduct (which they do SPECIFICALLY because of how many grey areas give cops unlimited power.) Simply ask him what the decibel level was- and how the violation was recorded.

    Also- I know that canadian cops are often like this- because they hate having their power questioned-

    But something that helps stop that power trip in its tracks. . . mention that any searches- questions- or conduct that occurs- that you disagree with- will be met with i direct action suit against _____(inert officer badge number) PERSONALLY.

    (hell- if you want to make him sweat *AND HAVE NOT GIVEN HIM EXCUSE TO BUST YOU YET- mention that a civil lawsuit allows you to take out a lean against him as an individual- . .. . lets see how much he thinks he's 'right' when he is at risk of losing his house and everything he owns)
     
  14. It turned out ok, I think I am definetly going to dispute the ticket. Found out this morning that right before the cop came in my friend hid the 4 bongs on the deck and 2 of the 4 bags.

  16. I would definitely dispute the ticket. If he forced his way into your house after you refused, he can definitely get into a lot of trouble for that
