Gov. Andy Beshear of Kentucky Signed Executive Orders

Discussion in 'Marijuana Legalization' started by Deleted member 1153948, Nov 15, 2022.

  1. According to the video posted on youtube of the signing, Gov. Andy Beshear signed Executive Orders for two orders making possession of up to 8 ounces of medical marijuana bought from another medical marijuana legal state, legal in the state of Kentucky. A patient must have a letter or other written statement by their physician saying what qualifying condition they have that is on the list of 21 medical conditions or are terminally ill. This allows the patient to go to another state that has a medical marijuana laws to purchase/possess up to 8 ounces. Anything above 8 ounces is a felony. The list can be added to later. The second executive order made legalizing and regulating Delta 8. It sounds like he decriminalized the possession of marijuana 8 ounces and under. It's a start and it now makes Indiana surrounded by some sort of legal state. I hope this means Indiana will go forward on medical marijuana or at least some sort of marijuana laws get passed in the lame duck session. These two new laws for Kentucky will take effect Jan. 1st, 2023.

  2. i wouldnt hold much to that ,your state might allow it but forgot to mention that federally your crossing state lines and federally it is still a schedule 1 , so might be a good idea to get your P's and Q's right before hand and sounds like the perfect trap for money back to gov in fines especailly crossing state lines

  3. A big start for Kentucky but it still sucks. The way I read it is those caught with MMJ could still be arrested before being pardoned. I hope that's not the case. "Because the governor cannot by himself change criminal statutes or direct police not to enforce certain laws, it means that patients could still potentially face law enforcement action for possessing medical cannabis, even if purchased legally in another state. But it does mean that they will be considered pardoned for the offense."

  4. It makes using and possessing less than 8 ounces not a crime. But above 8 ounces is a felony. I think this is all that he could do. Republicans and Democrats both have their own bills for making marijuana legal on a federal level but getting them to work together for the greater good is like trying to get North and South Korea to be friends and open things up for trade. I don't care who passes it as long as it gets passed. I think it boils down to who will get credit for legalization.

  5. It looks like possession is still a crime even if you bought medical weed legally in another state, which may not be all that easy to do since there's no MMJ permit or license, all they'll have is a doctor's note certifying they have one of the 21 allowed conditions and dispensaries in surrounding states may not accept that. Possession is still a crime that hopefully won't be enforced and if it is, it'll be pardoned and pardoned crimes remain on your record and will show up on a background check along with the pardon. But I'm not a lawyer, that's just how I read it.

  6. The video on youtube of the announcement will probably be more clear than me. That legal jargon they used gave me a headache.

  7. At lease someone is doing something. Andy Beshear has my vote for reelection. Kentucky has been a joke long enough. Can't wait to get my card. Hello Buckeye state. Here I come.

  8. I was born in Kentucky, raised in Kentucky, and spent much of my adult life there; I’d trust nothing said by any Kentucky politician or legal authority…

  9. I have to agree with you on that. I was born and raised in Kentucky too. And one thing I have learned about my home state is don't believe it until it becomes law. Maybe people of Kentucky will elect a more liberal government but I'm not going to hold my breath. The south has the most conservative states with the "good ole boy" attitude that I will be shocked and surprised if cannabis becomes legal. Especially in the states that have distilleries as a major income supplier. I guess they are afraid that people will consume less alcohol in favor of cannabis. Western Kentucky is made up of coal mines, farmland, and a few distilleries. Good paying factory jobs are hard to come by. That's why Owensboro is labeled as the "fast food capital of the world." There are more fast food restaurants on Frederica Street than anywhere else. And it's hard to pay the rent, utilities, and food on $7.25 a hour. And the Republicans, especially Mitch McConnell, have refused to raise the minimum wage in that state. Why? Because the rich factory, distillery, and horse farms want to make as much money as possible and have little overhead. So, Republicans are for the rich and Democrats are for the poor. I'm sure our founding fathers modeled our government after England. Conservative party-Republicans, and the Labor party-Democrats. With the exception of a monarchy. Why all the parties don't just work together for the greater good is beyond me. Just because it's a Republican or Democrat or Independant idea doesn't mean it's a bad idea. And I think people won't give up drinking just because cannabis is legal.

  10. Well, you guys just killed my buzz. What you guys are saying is 100% true. I believe it when I see it. Thank you, Andy for trying to do something. I just hate our money going to another state,

  11. I left Kentucky a final time in 1993,,, miss my extended family but no other regrets… Been in Northern Minnesota coming on 30 years now,,, again no regrets… Cannabis is decriminalized here, and may indeed very soon be fully legal… In all these years, never a regret for moving here…

  12. I was born in Washington D.C. Lived in Maryland most of the life. Been here in Louisville since 1997. I have two brothers who still live in Maryland and a daughter in Oregon. Both legal states. I'm embarrassed to tell anyone I live in Kentucky. It's that bad. Mexico should make weed legal. Half of Texas would move there.

  13. Isn't Texas a Republican state? Sen. Sessions of Texas was at a committee meeting that Sen. Nancy Mace was holding about the Federal legalization of cannabis. She said that after she was raped at 16, she started smoking cannabis to help with the depression and PTSD. And Sen. Sessions went on a 5 minutes, or longer, rant about drug statistics of people that die of an overdose or killed by someone driving under the influence. And crime rates. The meeting can be found on youtube listed under the channel, "Legalization News."

  14. My head hurts just thinking about it. Republicans are supposed to be about smaller government. Instead, they want government to rule you like a king. You must bend to their will. In this last election I voted for Rand Paul who is pro weed. It doesn't matter to me want party someone belong to. The last line of the pledge of allegiance says liberty and justice for all. What's the fuck is wrong with that? If our leaders can only live by that.

  16. Yeah, I see a trip across state lines for me next year. But I'm not a lifelong resident of Kentucky anymore. I'll have to take my chances anyway. My daughter said that there are other immune supressant drugs out there to control my RA but I don't like the thought of not having an immune system to fight off getting sick, especially with covid still running around out there.

  17. What about ordering it online? I don’t know if that’s possible to do but I remember my friend in Canada who works at a dispensary telling me when they first got it, they ordered it online. Shortly after that, dispensaries opened. My brother and I were talking about this, born and raised in Kentucky. We’ve always been convinced it was the bourbon industry here that was holding it up considering how long they’ve been in operation and how much money they’re making. They don’t like to lose profits and they know cannabis is their #1 competitor.

  19. The only thing you can get through the mail is Delta 8, it's hemp and legal Federally but some states banned it. And yes, it is the bourbon industry that is holding it back. One Kentucky senator that opposes legalization owns a distillery. He's the one that said that he will oppose it "and if the voters have a problem with that they can take it out on me next election." Ok, I hope they do.
