So pretty much i got busted in a car. The cop asked what we were doing and i said we were just sitting (i was stoned it was my best excuse). He took our licenses went to his car, came back and without even saying anything he started dragging us out 1 by 1. He was extremely rough with us like when he pulled my friend out with no warning he slammed him against the car to frisk him. Everyone had some kind of bowl on them when we were frisked. Then he searched the car with his cop buddies and obviously found weed. The cop said he smelled it from a mile away but thats not possible. We weren't even smoking yet we were rolling a blunt. Now i hear on the police report they put that smoke was coming out of the car. Does anyone know if theres some way we can prove the cop lied and at least get some of the charges dropped??
In your case charges probably won't be dropped. Although he didn't truly have reason to search, he abused his power and found contraband. Gotta pay your dues and move forward. Next time my brotha just roll down the window a crack and have all the doors locked, the dicks can't get in than.. Proceed to sing a song " Keep on knockin but you cant come in" haha.
Haha yeah I know. We were on private property that belongs to my neighborhood. I live in a development so they have like a big ass building with a pool and basketball courts and a gym and shit. When we were sitting in the holding office or whatever we were just like why didn't we get out and pretend to go in. We were cooperating 100% but the cops just wanted to be dickheads. Im not even just saying that they really did. They took my friends cigs and broke them because "smokings bad for you". They kept calling another kid in the car retarded. When they were searching my other friends car one cop kept kicking it like what the fuck.
if he indeed put that smoke was coming out in the report and that is a lie, you should consult a lawyer. You said you were rolling a blunt. And if all four of you had bowls on you and there was bud in the car and you were rolling a blunt, i am positive he could smell it. Smelling marijuana is probable cause. You might argue that the weed evidence should get thrown out because of the "fruit of the poisonous tree" doctrine, but i think a judge would still allow it because smelling it would have been inevitable when he approached your car and made contact with you. Inevitability is one of the exclusions to the fruit of the poisonous tree doctrine. But.... If the only reason he was approaching your vehicle in the first place is BECAUSE "smoke was coming out of the windows"... meaning that that was the cause for the suspicion, then it would be excluded as tainted evidence due to the fruit of the poisonous tree doctrine because the resulting contact with you led to him smelling it. But that is pretty nit picky... and there are a lot of other factors... which is why you should talk to a lawyer if this charge is serious. If its just a minor thing and you havent ever been in trouble then its probably more cost effective to just do some sort of PTI and pay a fine... EDIT: 1,420 posts. 420. nice.

Well you did say you were stoned when the cop came up to the window. Are you SURE you weren't smoking even a few hours before? The smell could easily still be present. Anyway, thats my 2cents. My main reason for coming was to say as bad as it sounds, i feel a little better reading these threads about people getting busted (i was recently busted).
Cops are assholes!...well, at least most. Did he happen to have a dash cam that will show smoke/not smoke?
He put that he smelled smoke in order to establish probable cause, in case you got a lawyer you wanted the evidence from the search dismissed on a lack of probable cause. So now the only way you can get the evidence dismissed is to prove he lied, and you pretty much have no way of doing that. So now the cop just has to prove you were in possession of weed, since you don't have a chance in hell of getting that evidence thrown out on lack of probable cause, it'll be easy for him to prove you were in possession. He's just gotta show em the weed. Lesson to be taken from this: 1)do not trust the police, they are trained to lie and to break the law in ways that can't be proven in order to have you effectively prosecuted in spite of your rights. and 2) for fuck's sake don't do illegal shit in public places where you are likely to get caught. Look closely at the plea they offer you. If you have to take more than one drug test, I'd threaten to plead not guilty and tell them you're going to file motions to dismiss the evidence. Even though you don't have a chance in hell of succeeding at that, it may convince them to lower the terms of your plea to something more tolerable. I had my g/f plead not guilty on a DUI, and they sent it to appeals, and we had it sent back from the appeals court after that and she ended up, a)keeping her license, b) paying only court costs and not fines, and c) only having to go to 4 drug classes instead of 12. Cops and prosecutors hate it when you fight, but judges actually respect it, (in alot of cases), so long as you can control yourself and speak clearly and intelligibly). Think about focusing on your own innocence rather than making justifications or trying to shift it onto the cops.

when i got caught im pretty sure the police report said smoke came billowing out of the car, but werent even smoking when the cops pulled me and my buddies over. They embellish alot. But since you all had weed or pipes on you, its gonna be tough to get out of it

Hate to say it but the judge is going to take the cops word over yours 100% of the time unless you have good evidence against him
We were smoking but only in my car which they searched but didn't smell weed for some reason. We switched cars (his is a lot less ghetto) smoked a few cigs while waiting for the rest of my friends then they got in and started rolling the blunt. So no weed smoking was done in that car.
