St. Louis Circuit Attorney Kim Gardner says her office will no longer prosecute cases involving 100 grams of cannabis or less, and her staff will begin reviewing and dismissing past cases. ( emphasis mine) Jeff Roorda, the business manager for the city’s police association, was shocked by Gardener’s decision, stating, “There’s a name for someone who drives around with 100 grams of marijuana in their car — drug dealer! Anything over three grams is a felony. The prosecutor has a constitutional job to prosecute felonies and she’s choosing not to do her duty.” The city decriminalized possession of up to 35 grams in 2013, but police have continued to cite people for possession, with Black people making up 85% of those citations. And while they’re only receiving a citation in lieu of arrest, attorneys warn the citations will show on a background check. “People think this is nothing, but if you plead guilty to it, even it a municipal court, it would show up in a criminal background check,” stated attorney Andrea Story Rogers to the Riverfront Times. “It doesn’t matter how low the fine is.” One more step in the right direction for a major city!
