Entrapment?

  1. Can cops pose as bud dealers and bust you if you buy from them? Is this entrapment or does it count since you probably would have bought before you knew the guy was a cop?
     
  2. im pretty sure they do sting operations where they pose as drug dealers.

    Sting operations come very close to entrapment. However, most police operations ensure that they won't get caught by defense attorneys on charges of entrapment.

    In order to avoid the charges and prove it was entrapment, you must prove that you would not have committed the act if the police hadn't done what they did.

  5. Couldn't you say you felt in danger that if you didn't buy from him he'd hurt you? Or some sort of story like that?

  7. not too familiar with entrapment issues so i got a question.
    what would be "something they hadnt done"?
    its a bust... they are trying to sell you weed and arrest you. if they sell you weed, thats what you AND them want.

    Even when there is entrapment it's pretty much impossible to prove. Rarely does it work as a defense.
     
  9. Since you are willing to buy from them they pretty much figure that if they weren't there you would have bought it from somebody else anyway.....because you obviously had the intent to buy.
     
  10. cops usually don't go undercover just to bust a normal pot head. Unless you're trying to buy upwards of an ounce (probably very much upwards) the cops aren't going to blow their cover to bust someone like you
     
  11. most cops are out buying drugs from dealers, just to gain every bit of information they can so they can make a planned out arrest with minimized danger, cops typically try to catch dealers not the end of the line people :smoke: but if that is the case, i believe entrapment is if you say hey, are you a police officer? and they say no and then arrest you for buying from them. if you have that suspicion, and even if they say no, i would still be sketched out. but if you go out asking random people for an illegal drug, and it happens to be a cop, that's legal on their part to make an arrest
     
  12. have you ever seen COPS? ive seen a few clips on that show where an officer poses as a drug dealer and sells people dime bags....DIME BAGS...and then the police roll in and arrest someone for buying 10 dollars worth of weed. it sucks but hey, when your in court your defense really doesnt ammount to anything when your going against a police officer. There really is no point of going to court when your defending yourself against a police officers actions, they will ALWAYS win
     

  13. a big part of this is that YOU ask to buy...if they offer to sell it IS entrapment (they used to do prostitution 'client' bust like this...)
     
  14. what world do you think you're living in? at least here in the U.S., police officers can and will do anything they please, there is no such thing as "entrapment".
     
  15. That's a common misconception. Cops don't have to tell the truth, they can lie right to your face and still arrest you.
