DUMB question about MMJ

  1. Firstly I will say I dont live in an MMJ state.


    What are the laws for states that HAVE MMJ already in place?

    If I travel, am I not allowed to bring my medical pot? What if my doctor is in another state? Completely possible for me to be visiting a doctor in a state that its legal, and not actually live in that state. So if I get approved, then travel back to my home state - am I going to be arrested for having MMJ?



    People ALWAYS like to push buttons like this. But I havent seen anything about it make any kind of "national" news. Just curious for you MMJ people what the "rules" are for traveling. I live on the border of a state that doesnt have MMJ but jump the border and its legal. Im not looking for a loophole to get pot, I truely am someone who can benefit medically from it. But this has HAD to come up before. Do I HAVE to be a resident of that state in order to get a MMJ card of that state? Any help/comments would be appreciated

  3. Correct me if I'm wrong, but in order to have a state ID card, you have to be a resident of that state, correct? Like, I live in California, I couldn't go to Las Vegas DMV and get a Nevada ID just because I'm visiting.

    When you get your medical marijuana card, you have to provide a valid state ID or driver's license, for the state the MMJ ordinance is passed in. Every time you go to a dispensary, even if you already signed up and have been there before, they are supposed to request your ID. Some places skip the procedure, but you get what I'm saying. I don't think you could live out of state and get it.

    I could be wrong though.

  5. Again, it may vary per state as far as issuance of a MMJ card -- but there is no law that says I cant goto a doctor and get treated and prescribed by a doctor in another state. I dont need to be a resident of that state to goto the doctor in that state.


    Perfect example on the east coast would be say the tristate area. NY/CT/NJ You can hit all these areas with ease. NJ has MMJ, NY does not. So, what if my doctor is in NJ and says its ok? But I live in NY? To get a MMJ card do you specifically know you HAVE to be a resident of that particular state or do you just have to show a valid photo ID?
     

  6. Laws are state specific. Do not assume anything unless you study the laws. If you have cannabis in a non-cannabis state - you are treated as a drug possession case. It is a federal offense to take cannabis across a state line - even if both states have medical cannabis laws.

    Only in Oregon and Montana, can non-residents get a card - if they qualify and are examined by a state registered doctor.

  9. Just doesnt seem right in any way shape or form.

    I dont understand our government, sick of people not asking questions and voicing their opinions.

    If its medicine, I should be able to travel anywhere in the U.S. - and if its NOT medicine, then the govt needs to step up and stop the what, 14 or 15 states that already have medical marijuana. And that aint happening... and more and more states are looking into it, so its about damn time for the govt to at least step upto the plate and say well clearly 40 years of shit drug policy hasnt worked - time to try something else. Sorry, ill stop ranting :D

  11. I saw an article by a new york reported who went to cali and got a card there, even though he is a resident of ny. Im in az and the laws arent in effect yet, but they say that visitors who have out of state mmj will be recognized as valid.
     
  12. Wesside- According to California law, the reporter had to have had some form of CA ID! The "el cheapo" clinic are pretty free and easy about giving out recs, but if he didn't have ID showing he resides in California, they broke the law. Now, in Oregon or Montana, it would work- you do NOT need to be a resident of those states to get a rec.

    I would appreciate it if you would hunt down that article and post it up. :D

  13. Yeah, there seems to be a lot of "stretching the law" out in cali. Whether he was able to get into a reputable dispensary and actually make a purchase wasnt mentioned. He did mention, "technically" he shouldnt have been able to get a card, but it was actually quite easy to do. Unfortunately I dont remember where I read that article (it might have been linked up somewhere on this forum) and am a lazy stoner. If I ever run across it in the future ill put it up.
