"Drug-Free" zones

  1. I have searched all over for info regarding the MMJ laws and growing for Medicinal purposes in a house within a "drug-free" school zone(specifically in OR) and have found little to nothing. Apparently, some say that if you live and grow or even possess near a school you are OK as long as you have a good lawyer. The OMMP says nothing in this regard other than ask your attorney. Norml just suggests you find another place to grow or move.
    This seems like it could turn in to a loophole in the law that errs on law enforcement's side. You tell OMMP your grow address, they file it away, the cops find out your growing one way or another and they just don't care about your card because they believe at that moment that the "drug-free-zone" laws trump.
    Anyone?
     
  2. Even if you eventually win after court hassels, they already destroyed your plants, confiscated your equiptment, and shot your dog. (Worst case senario)

  4. Well, Where does the law stand? Is it illegal to possess, grow, use, etc medical marijuana within 1000ft of a school in OR or not? The law seems to not take a stand on yes or no. It's almost setup as if someone has to get sacrificed to the courts in order to ammend the law later down the road.

  7. This is a great question. I also live in OR, and I would like to know. I thought the rule was that you couldn't grow/possess within 1,000 ft, but if that's true and you need your medicine, then you're screwed. I don't know... :confused_2:

    You may have to ask clinton. He knows a lot more about MMJ laws in OR than most people here. He might be able to answer your question...

    Ya, I'm no lawyer -just someone who thinks too much- but I've read both laws and I would think that if it were set in stone (like most laws aren't) the 1000ft rule includes MJ but the OMMA says that it's OK. But neither mentions the other as an exception. Sooo they contradict each other. I just hope that someone doesn't have to go down as a casualty of this just so the courts can figure it all out.
     
  9. No, the OMMA says that it doesn't address that issue, and to talk with a lawyer about it. Yeah, that's really specific. :rolleyes:

    I think you mentioned you visited NORML? If NORML is telling you that you need to move/grow somewhere else, I would imagine it's because they got a lawyer to interpret the law, so that might actually be your answer. I know it sucks, and it's not the one you wanted, but that's the way the cookie crumbles, I guess. :confused_2: :(
     
  10. i think youll be okay as long as its a mmj. because its like you have a prescription for it. you dont see cops bustin people who take viccodin on school grounds.

    idk i could be wrong. thats just my logic.:)
     
  11. With a little bit of law knowledge, I know this is a very gray area. I would talk to a lawyer and/or someone knowledable in MMJ laws. I believe it is illegal to do so, but if taken to court...you would most likely be found legal to do so and clear. :wave:

  12. ...after the cops came to your house in force, disturbed your neighbors you've spent a night in jail, got your name in the newspaper, lost your job. You may win in the end, but at a terrible cost. All this for not hurting anyone while your alcoholic neighbor drives past the school everyday with a snootful of booze endangering the children & nothing happens to him. Nice "free" country we live in.

    If I lived near a school I wouldn't grow outdoors that's for sure. Hip kids would know the smell, rip you off, get caught and rat you out in a heartbeat. Then because you "allowed" access to your dangerous narcotic, you would be screwed.

    It's all so ridiculous because there is probably weed already in the school.

  14. I didn't personally talk to Norml about this, I just found a comment from someone that represted Norml somewhere on the web. Not sure if it's what the whole organization believes or not. Might be worth looking into though
     
  15. Even if a lawyer offers his opinion that it is ok to possess/grow w/in the 1000ft school zone with a medical card, it is just his opinion. It is still up to the judge/da/jury if you hang.

    This issue concerns me because we are looking for a house to buy. I would for sure only grow and medicate indoors. If I were to grow it would be stealthy as hell.
     
  16. It's not like I live even close to a school. I was just studying the laws as their written and noticed the contradiction. I wonder if any of the MMJ organizations are addressing this. What this community needs perhaps is more people with legal knowledge on the issues and a willingness to be proactive in more ways than just defending people who have already been busted. Oh wait..there's no $$ in that is there?:rolleyes:
     
  17. Ok, then I wouldn't trust it. If NORML themselves had published that, then maybe. I don't know, though.

    Dammit! Somebody somewhere has to know the answer to this question ...
