I was watching cops on t.v. one time and during a stop I heard them ask the guy if he had anything illegal in the car. If you get pulled over and you have weed in the car and a cop asks you that question, what should you say? If you say no and they find weed in your car, then I think they can charge you with obstruction of justice. And if you don't say anything at all, then I'm pretty sure he'll call the dogs in to walk around the car and if the dogs smell anything then that's probable cause to search the car. I'm guessing the best thing to do in this scenario would be to just say no if they ask if you have anything illegal in the car. What do you guys think?
You have the right not to incriminate yourself. Say no. Obstruction of justice refers to an investigation. check your federal, state, local laws to verify this.
dead on R_M. Despite what EVERY police officer will tell you upon being arrested, they will not go easier on you if you help them out. It is their job to arrest you, and gather all possible evidence against you, and charge you as seriously as possible. The only reason they want you to "help them" is to make their job easier, and make it a simpler process to charge YOU with crimes. Never incriminate yourself, no matter what the officer's tell you, never admit to anything, or help them find contraband before speaking with a lawyer. You dont have to make yourself guilty, just remember that if they didnt find it out for themselves, they shouldnt know it.
Unless you make a deal with your lawyer and theirs to do some kind of report where you give names (for example) and they lessen your punishment. Usually that's only for more serious stuff than a recreational amount of mj though
well, if they ask you to step out of the car all you have to do is lock the door and wa'la, they need a warrant, and unless they can point out probable cause (that means you/the car dont smell like weed, and you dont look high) then he cant legally search the car because you are simply asking him a good reason for why he wants to search the car without bein a smartass about it it probably dont work, but i saw it ona video about how not to get arrested with weed haha

Yeah but a police officer will just tell you that it's for his protection -- we've all see those police videos of some idiot smashing into the back of a parked cruisers or car during a traffic stop. If you refuse to get out of your car, and it's not a law (i don't know that, I'm just playing devils advocate) then you're probably just fucking yourself over, cause then he'll either physically remove you, or go for the mace / taser.
Better to give ur rights then die. You will have a chance to defend ur self in court and maybe get charges thrown out.

"A habit" This gives him no ability to step inside the vehicle, or use mind games to have you give him permission to search the vehicle. *Steps towards the car* "You don't have anything illegal in here, you don't mind if I take a look do you?" "No." Was that 'No, I don't have any illegal drugs' or 'No, I dont mind if you search the car'. Doesn't matter, you just consented to a search. If the officer asks you if you have anything illegal in the car, just laugh it off casually and say, 'No way, sir.'
In my 3 experiences with cops...its been the exact opposite. First time, they caught us in a parking lot and we were rollign a blunt, but we hid all the evidence before he came to the car..he asked what we were doing and we obviously lied..he made me get out and asked what we were really doing "if u lie ur screwed if ur honest ill help u out blah blah blah" in the end on the hood of the police car was: 2 blunt wraps, eye drops, lighter, green bong, and my sick bowl the 2 cops were arguing who got to keep the bowl actually one was like "no no no ill take it, i have a good plastic baggie to put it in" hahahaaaa second time, we were at this party, trying to roll a huge 9 gram blunt, the blunt ripped so we decided to go to the store. i had a cup of beer, and the driver was a girl drinking tequilla lol so we go to the store, im drunk, buy 10 blunt wraps, and get back in the car....they pulled us over, i had 9 grams and 10 blunt wraps, and they let us walk hahaaaaaaaaaaaa
as far as the locking the car thing goes, it works. I do it even when i don't have shit in the car as a matter of principle. when i got fucked it was cause my buddy was told to stay in the car, i was faded like a motherfucker, and when the cop came at me threateningly, i balked just long enough for the other officer to find a tiny sack. But anyway, when you're asked to step out of the car, cut the engine, shut the door, and lock it. before i got a car with automatic locks, i would actually walk around the car, checking every door and the liftgate, locking the ones that were unlocked, then i told him to have at it. Every time they'd try to intimidate me into letting them search things, i'd sit down on the curb and tell the cop to call a judge and get a warrant, then i'd throw something in like, "if you want to wake a judge up at home to get a warrent, then search my car and look like a dumbass for not finding shit, that's up to you. they'd usually make some comment as they're checking for things in plain view, and then i'd ask, "officer, am i under arrest or otherwise detained?" half the time they'd say no to me being under arrest and then start to get mad when i'd get back in the car. I'd respectfully tell him that he already told me i wasn't detained, which meant i was free to go, then i'd get in, buckle up, and drive off with him still standing there. worked like a charm. my bust was bad luck on no less than 4 counts. if any of the 4 would've gone differently, i'd still have all my shit, and i'd still be toking on the daily.
hmmm, thats a tough one to believe....you just driving off and leaving a cop standing there and him not doing anything about it...hmmm. Perhaps but man, thats a tough one. Plain and simple without all the rambo shit...You have the right to say no to a search, if they're asking you then chances are they have no probable cause. If they did they wouldn't ask. Same goes with your home. Just keep in mind, odor is PC....Be safe out there, there are some baaaaad people getting away with crimes while these cops fuck with us for smoking weed!
