had an 8 hour class for some wreckless driving awhile back. the pig teaching said that when he crosses his finger/pen in front of your face and you've been blazing (or other things...i suppose) your eyes will do some fluttering. may have been pupils bouncing...something along those lines.

Prior to starting the exercise, I insured my front overhead emergency lights on my patrol vehicle were turned off leaving only the rear flashing lights. I explained the exercise and gave the exercise instructions to the driver. I observed a lack of smooth pursuit: in both eyes.
I observed a distinct and sustained Nytagmus at maximum deviation: in both eyes.
I observed the onset of Nystagmus prior to 45 digress: in both eyes.

Lay observations and statements while completing HGN:
The driver was not wearing contacts or glasses.
The driver has brown eye color.
The driver was wearing black tennis shoes for footwear.
I observed the driver have a slight orbital sway (counter-clockwise) while completing the exercise.
The driver stated he has smoked marijuana earlier in the evening, but did not have on his person."

Try arguing that in a court in front of a judge by yourself.

Yes, he was on like the DUI team, he had only been a cop for a year, but his report was about 3 pages long. Even if I had a tape recorded recording everything he said, he pretty much did eveything perfect, even my lawyer was amazed. For many reasons I should not have gotten on a diversion program which I will not mention, but my lawyer pulled some strings and I managed to get a reference from the DA and got on which saved my life, because I really didnt have a strong case.
