Charged with Possession in Illinois

    Hey GC, I badly need some advice. So about a week ago I was driving around hotboxing with some friends and the driver was so stoned she accidentally pulled into an abandoned parking lot with a cop across the street. They called in a K9 unit and found all our weed. The next day when my friend got her car back from the place where they towed it to, ALL THE WEED WAS STILL IN IT. They took our bowls, but they left every last bit of weed and my pipe tool. We were in the southwest Chicago suburbs. None of us got arrested, we all received village ordinances, but we were all charged with possession of paraphernalia and 2.5-10g, which is a Class B misdemeanor. We are all going to have a court date. This is not quite my first offense; I was charged with shoplifting when I was 14. I'm 18 now. I haven't told my parents and I don't plan to since they are extremely strict and would probably pull me out of college and send me to rehab or simply disown me, no joke.

    So I had some questions:

    1. Do I absolutely have to hire a lawyer because I don't think I can afford that...
    2. What are some good ways to make money since I definitely am going to need cash later on? Is it going to be extremely difficult to get a job right now?
    3. What the hell is going to happen to me? I mean what are the punishments really looking like? This is my first drug-related offense. I realize I probably won't go to jail or anything (God forbid) but what would the fines look like?
    4. Is there anything I can do to minimize the shit I have to go through later?
    5. WHY THE FUCK did they leave the weed in the car? And what does this mean for us?!

    Thanks so much. I've been really freaking out about this recently since I really am not in a position where I can tell my parents and I know I'm going to have to go through a lot of shit to get the cash. Any advice at all is appreciate. Thank you <3

    in situations like that i did not think everyone would get charged, just one of you that takes the fall... Is not 1 individual from your group willing to take the blame to prevent all of you from getting possession charges?

    Sell plasma to get money. First drug offence is usually a fine and taking a class. Im not sure of the laws in Illinois but that's how it worked here in NC. If they left the weed in the car it might have been an oversight or they decided not to charge you for it. If anything when you go to court they cant use evidence against you that they dont have.

    They definitely put the amount of weed and such in our paperwork and we all got charged since none of us were going to take the fall for it. I don't weigh enough to sell plasma (eating disorder, long story) but is there any way I could fib the weight? How many times can you sell plasma? Also, does anyone know how much the fine would be?

    id just pay the ticket, take the classes and go on with my life, this being on your record could cause future problems like lets say your pulled over for running a light, once they look you up they'll see you had been charged with possession, this could lead to cops searching you and your car everytime you get pulled over

    They can put it on the paperwork all they want but if they don't have the weed I fail to see how it can be used against you. It can't be presented it in court unless you get a judge who takes it on good faith. I've never been to court but I feel any lawyer who knows what he is doing could get the possession charged easily dropped.

    You cant fib your weight at a plasma place because they give you a full physical. Also check this site out:Illinois Penalties

    So I guess I'm looking at about $750 for paraphernalia? What if I don't have a lawyer? I'll just try to gain the weight for the plasma donation thing.

    So what exactly was your charge? Possesion of paraphanelia? Possesion of a controlled substance or both?

    I had two - Possession of 2.5-10g of cannabis and Possession of Paraphernalia.

    You don't need a lawyer, go in and request a public defender.
    "If you do not have an attorney, one will be appointed to you."

    My first time possession 2.5-10g cost me about $2500 before my lawyer.

    What's wrong with you that the first thing you think of is lying about your weight to give plasma to get money? It's called a job, you go somewhere and they pay you to do things for them. Weird, right? Get a snow shovel and go knock on some doors.

    I say go to court and play it by ear and that shoplifting charge shouldn't be held against you because when you turn 18 past offences get locked or some shit like that. Most likely they'll drop the possession charge and give you the paraphernalia charge and make you pay some fine and take a class. As a first time drug offender there should be no jail time.

    How much time did you have to pay the $2500? And I know, I've applied for a bunch of jobs already and I'm waiting to hear back/making calls but it's hard for me to get hours since my parents don't want me working right now so I can only work during the week while I'm staying at school. Perhaps I should have mentioned that.

    What that guy said is lies, a juvenile record can still be seen once you are an adult and in many cases the judge looks at ANY past history to make a decision

    I wasn't sure but I think you're right because I never paid to have that past record expunged. Hopefully he notices that I was fourteen years old and being a dumb fuck. However, now I'm eighteen years old and still being a dumb fuck. /terrified

    Ok I just looked it up and it is sealed by the public but the judge can look it up. Sorry. I had my facts confused. Apparently juvenile records can be used against you.

    Heres some advice i gave a friend.
    Show remorse (he cried lol) the judge is not all and mighty you as a normal person can talk to him in this situation, let him know you feel stupid now that youve got time to think about it, be respectful, speak as professional as you can, no slang, and make eye contact, dont laugh either stay serious, dont mean mug the guy either while making eye contact, let him know your situation

    maybe you can explain that you are in school and unemployed currently but are trying to find a job, say you applied at mcdonalds and you feel confident but that you may need time to pay off the fees

    Idk if my friend got both charges or just one, and he had no previous record, all he got was a ticket i forgot the anount but it was more than 200 less than 300, we live in CO though so i guess its not all that relevant

    Uh, how are my parents supposed to find out unless I tell them? I'm having the paperwork sent to a different address and I'm eighteen. And thanks for the advice, I actually did apply to a bunch of restaurants around school and such and I'll be as remorseful as I can. Hopefully the fees are around that amount for me too or not too much more.

    Bumping this because I have another question - am I going to be drug tested? Also, an update: I have a job interview tomorrow, basically told my parents I'm getting a fucking job no matter what they want me to do. So hopefully that goes well.
