can you get arrested in Canada for 1 or 2 plants with the new crime bill?

Well I know where I live federal law states anything from one to 99 plants first time is a misdemeanor with up to five year sentence but you only serve up to two years. If that makes any sense. Not sure how that'll work now that we passed medical. You would hope anything under six they'd just kill em and toss em. Depends who gets you I guess. Regular police or the federal pigs.

 

From my understanding, five plants or less is a mandatory six month jail sentence, and six or more plants is a more serious charge.

 

if your record is clean, you can go without jail time... only probation and a fine or maybe even less... Really tho, it has got a lot of factors to play so you never know. just don't think about it and find a good spot if your growing outdoors. you can tell someone is growing when you meet them near their crop and they are nervous.

if your growing for personal its limited to 1 plant. you'll get a fine , and they will take all your Equipment

The crime bill you're talking about is Bill C-10. (Just a horrible piece of legislation, I might add)

Under the new laws cultivating anything over 5 plants is punishable by 6 months mandatory minimum jail sentence if the cultivation is for trafficking purposes. The more you grow the more mandatory time you face.

Here's the change to the law from the open parliament website:

(b) if the subject matter of the offence is cannabis (marijuana), is guilty of an indictable offence and liable to imprisonment for a term of not more than 14 years, and to a minimum punishment of
(i) imprisonment for a term of six months if the number of plants produced is less than 201 and more than five, and the production is for the purpose of trafficking,
(ii) imprisonment for a term of nine months if the number of plants produced is less than 201 and more than five, the production is for the purpose of trafficking and any of the factors set out in subsection (3) apply,
(iii) imprisonment for a term of one year if the number of plants produced is more than 200 and less than 501,
(iv) imprisonment for a term of 18 months if the number of plants produced is more than 200 and less than 501 and any of the factors set out in subsection (3) apply,
(v) imprisonment for a term of two years if the number of plants produced is more than 500, or
(vi) imprisonment for a term of three years if the number of plants produced is more than 500 and any of the factors set out in subsection (3) apply;

So, 2 plants is no big deal, they're going after the big time growers who are 'connected'. Read the bill yourself, it's a lot of legal mumbojumbo but it's important to know the laws if your going to make the decision to grow.

Weed is still illegal so be careful because if they catch you there will be consequences!

So;
it sounds to me the best bet would be to grow a maximum of 5 pants, and to do a scrog and try to get the bigest yields out of those 5 plants.
and keep the mother plants/ clones at a diffrent trusting resident....
Does that sound right??
