Can a cop make you take a blood test?

  1. As far as I understand, if somebody were to be charged with a PI, they would have to have some evidence against them to say they're high. Say a cop came up on me and I was clearly just gone out of my mind. Broke eyes, smelling like weed, all that. Say he gave me sobriety tests and I passed them, but he was still certain I was high and was dead set on getting me.

    Well a blood test would be the only definitive way to tell if one is high, no (at least in use, I've heard of new methods coming out)? So could he use probable cause to make me take a blood test? I've heard they can and heard they can't. I honestly couldn't imagine them being able to force you, but I just wanna have some clarification.

    And if they can't, does this stand true when you're driving too?
     
  2. I can't see that happening. I feel like there would be a lot of paper work for a cop to do your blood
     
  3. I'm not sure if this is relevant, but I got fucked with pretty hard by some cops back in May. When they handcuffed me, one of the cops commented "you're fucking brain dead" but didn't charge me with anything like driving under the influence or anything. And they definitely would have, if they could have. (they did give me resisting arrest even though i wasn't) but as soon as they cuffed me i said all the ACLU shit (i don't consent to any searches, I'm going to remain silent, I want to talk to a lawyer).

    to my knowledge, blood tests fall under 'any searches'

  5. Why wouldn't they give you a piss test before a blood test? it's only the most common way people check for drug use like weed
