California: Legal to sell Medical cannabis to another patient?

  4. the laws on that are very ambiguous. however as long as the transaction doesn't take place in front of a cop there is nothing they can do, since you both would legally be allowed to possess it.
     
  5. i know you can grow for other patients on a co-op farm, but it is technically illigal to sell it to another patient just as it is illigal to sell any other prescription drug to another person with the same prescription. technicalities
     
  6. as far as i understand the laws, cannabis clubs have to be lisenced by the state as MM dispensiaries, and as a card holder, you are NOT liscenced in the same way.

    the post above makes sense, that as long as the transaction isnt in front of a cop, then its NOT illegal, because you are both allowed to posess the weed, its only the transaction thats illegal. Unfortunately, I would imagine that you could be busted for intent to sell MM if the circumstances made it obvious that you planned to sell it, even to other patients.

    I think the only legit way around this law is to "share" the weed with other patients, and not make an obvious transaction, but even thats fishy.

  8. I am also a California licensed patient. The answer is "sort of". You are each allowed to possess up to 8 oz. of dried cannibas. So you can supply him with meds, and he can donate money to you to cover your costs. "Sale" of cannibas is not legal at dispensiaries. Donations to cover the costs of supplying you the meds is what happens instead. You do not need to be a patient to supply meds and accept donations, you need to be licensed as a caregiver, which is only slightly different from being a patient. On a paper stapled to the bag from a dispensiary are some printed rules, such as how you are not authorized to share your meds with non-patients, hence making sharing your meds with patients just fine. So if you and your roommate are both patients, only 1 of you needs to go down and get the actual meds, it doesn't really matter when he gives you the money for it. Yep. That's it.

    I am also a Cali Patient ant it is my understanding that in order to be a primary care giver you need to fill out a form basically designating someone or club as your primary caregiver. At that point you are basically saying that as a patient your relying on this "source" to provide you with your meds. However that person or club has to keep your info on file in case the law decides to stop in for a quick audit.... which they do.

    But thats just my understanding I could be wrong the laws here are skethcy at best.
     
  10. you CAN NOT sell unless you are a registered caregiver

    You are not even supposed to give or "gift" pot to another patient unless you are a registered caregiver

  15. If you live near oakland you can just go to OCBC and ask for the caregiver form, takes about 10-15mins to fill out and then you are good to go.
     
  16. so i did go to google the best I can see is that you need to just check with your local county and apply that way. but again who knows how accurate anything on the internet is.:hello:

  18. Cannabis dispensed at dispensaries is now considered a sale and is subject to state tax. Here's a receipt from some cannabis I put on my Visa. I love California!
