    i know this may be the wrong forum (im new) but if i were to direct this question at anyone it would be a seasoned toker. sooo going on....my friends parents were fighting and the cops were called, the whole fight was about a plant. while in my friends back yard a cop finds a maybe a 3 week old plant. they then continue to take his keys out of his pocket and use them to unlock his door to gain access to his room and to search his locked car. after desroying his room they find bongs,herb, and 20 some odd germinated seeds (the list does go on). my friend was hauled away to jail with out even having his right read to him.

    does probable cause mean the cops can unlock his door and car ?
    is the fact he was not read his rights a big deal ?
    do you think the cop will lie about reading him his rights ?

    my advice would be to get a lawyer. a good lawyer could really help in a case where there may be some dirty-play on the cops part.

    The cop just reached into your friend's pocket and grabbed the keys? I'm sorry, but personally I think your friend may have stretched the truth, if only a little bit.

    I've met some pretty big assholes in my life, but never anyone that would have the gall to reach into my pocket and take my keys. And how would the cop know which pocket had the keys?

    I'm not saying your friend didn't get screwed. The cops probably did violate some of his rights, but I would bet money that he's exagerrating a little bit when he retells the story.

    they searched him and put him in cuffs outside when they found the plant.

    they turned his room up side down but never looked through the rest of the house...does that sound right ?

    Were there any other witnesses (Other than cops)? If so, try to get them to testify. If not... Your friend is screwed.

    yea if you have enough witnesses he may be able to get off on just the part about the cop not reading him his rights. Its illegal arrest or some shit.

    If you can get the cops for not reading him his rights, thats a big no no and there will be some extra people in the unemployment line very soon.

    I heard about a case awhile back where some dude got off murder because the cops didn't read him his rights... Dunno if that was true or not, but I know it'll be pretty easy to get a possession case dismissed with a lawyer if the cops didn't read you your rights... And no offense to you or your friend, but I agree that this story is very hard to believe...

    fuckin cops pulled one on me too......me and a friend were sittin at the end of a development in his car at id say about 12:30 and we were just chillin waiting for a friend to meet us (to get some more pot).....so a cop comes up to us and turns on his lights and asks for id.....then he tells us to get out of the car cause hes gonna search it......he found a pipe and like a gram of reefer.......looking back on it im pretty sure it was an illegal search......oh well.......i never heard anything from the cops so i got away unharmed, but i did lose a sweet three week old pipe.....fuckin pig prolly just smoked my stash.......oh well.....hes unemployed now because the township lost funding for its police force like a month after this all happened........haha.....

    if he didnt read him his rights, and u do have a witness, then some charges may be dropped, but the fucking douche bag cop will prolly lie, if u dont have a witness...but the probable cause...wen u said 'a plant', meaning a mj plant (im guessing), than yes they can search the house. i think that wud be a little more than probable cause. srry to hear bout ur friend tho.

    heres some details i left out:

    -it was a mj plant
    -his dad witnessed it all
    -the cop confiscated a black light and said he used it to grow
    -there were other cops but they all gave him shit (he was actually pushed by one cop into another cop into another cop when he tried to put his shoes on after he was told to go outside by one of the cops)
    -when my friend told the cop he wasnt saposed to search his car, the cop then said if they are called out to a location they then have the right (sound right?)
    -and my friend is meeting with a lawyer that does a lot drug cases later this week
