Busted with a lil under a oz

  1. Hey grasscity. I got caught with a oz with 2 8ths sold out of it, wasn't my fault, my friends thought it would be a cool idea to blaze a bowl in the car where all the shit was, and they ended up getting searched and shit while i wasn't even around, but long story short they found my shit and gave me a summons and shit, i was wonder whats gonna happen and what can i do to make it easier.

  2. How can you get any kinda ticket when not being there? Your friends aren't your friend they snitched you out saying that bud belongs to you.
     
  3. well i mean it wasn't there fault, the kids don't know there rights so they let the cops search everybody shit, and my ids where in there, so as soon as i walked over to see what was up i started getting questioned and shit.

    you had 3/4ths of an ounce.

    basically, because you had it weighed out in separate bags, you're looking at intent to distribute/presumption of sale, which can be a $2000 fine/1 year in jail. i had a friend who got busted with 20 plants and he only paid $1000 and did 72hrs in county, so keep your head up brotha.
     
  11. ^^did u even read? he had already sold the 1/4. no intent to anything. looks like anything under 2.5 oz's is just a misdemeanor, so its a slap on the wrist....probs a fine and a workshop type deal.
     
  12. considering hashmeer is my friend, and i've heard the FULL story, i think i might know a bit more about the situation than you. he had an ounce weighed out in 8ths, and a scale. if he gets a lawyer, he can certainly get a better deal outta the DA, but he's still looking at presumption of sale because of the separate bags.

  16. Ya bro, remember to only commit one crime at a time. Don't blaze if you're carrying weight. And don't have it bagged up separately if you have a scale on you. Get a lawyer and see what he can do. I'm hoping he can poke some tiny holes in the case, or at least fight off the intent to distribute charge.

  17. I would not write on the internet anything about selling it in case you really piss them off at some point and they do some digging. Cops have been getting a lot better with technology these days.

    Usually the statutes on intent to sell are usually subjective and seperate baggies/scales are evidence of your intent to sell that can be refuted with other evidence indicating that you were not intending to sell. In a situation where you got shit bagged up and a scale the presumption of your intent to sell is pretty high and hard to overcome. However, it may be possible to argue something like the seperate baggies were just because they were different strains or scale was to make sure you weren't shorted.
    They may, also, be receptive to a lower plea because you obviously aren't the top of the pyramid. Just remember they have some pretty decent bargaining chips in this situation and you may be in for a long time of dealing with them over this situation. Make sure you get a lawyer for sure.
