So, yesterday in the morning 'maintenance' showed up knocking at everyone's doors. I did not hear them knocking because of the dryer, etc. and my roommate had left the door unlocked but they let themselves in. I was standing there in my boxers in horror because the three that came in definitely saw paraphernalia and shit, and now this morning there are three $100 fines at our door. I'm seriously sick and tired of this place - it's awful. Was it even legal for them to come in without permission? No 24 hour notice, nothing. I'm pissed.
Most apartment buildings have a contract stipulation which states that maintenence is allowed on the premises for check ups (things like replacing the air filters, checking water pipes, etc.). You should pull out your contract and check it out. Every apartment I've ever lived in has been this way. I just kept paraphernalia in my bedroom, and changed the lock on the bedroom door so they couldn't get in.
Wasn't even my parphernalia (fucking roommates). They said they came to do a 'furniture count' and went into everyone's rooms counting that shit. Opening an unlocked door seems wrong to me. Either way, this place is shit and I wrote a terrible review for them on google.
This is what I am terrified of next semester when I live in my first apartment but the managers there said they give you at least 24-48 hours notice so should be fine....sucks to hear man
No, it's not legal to do a "furniture count" at random with no notice. That is in violation of the Texas Landlord/Tenant Law and you have a case. At minimum, fight the fines. At max, small claims courts. State law stipulates that for all non-emergencies 24 hours notice must be given. Counting furniture is not an emergency.
Did your apt come with furniture? I can see if a pipe broke or something but they just walked into your house to do a "furniture count"? I whould be super pissed,. I lived in a huge apt complex for a year and no one from the complex ever went into my house while i was living there.
That sucks. I hate maintenance as much as you probably do now. I don't know the actual rules, but where I stay now I've had similar issues. Once when I was working, maintenance came into my apartment (door was locked) and tried to go into my bedroom. The door was locked, as my girlfriend was asleep in bed. Seems pretty fucked up to me, but where I stay is a low income, government subsidized place, and a leasing agent at the new complex I applied at told us that they are allowed to basically come in whenever because of that. If I were you I would definitely be making your roommate(s) pay the fines since it was their stuff and they moronically left the door unlocked. I'd be glad it's not worse, if the maintenance people knew what the paraphernalia was for.
No they can't. Only in an emergency. What constitutes an emergency depends on your state, but the judge would laugh at a "furniture count" claim as an emergency.
i ust to work for the apartments i live at. Once a month we go in and change air filters and once every two months we go in and change the batteries for the smoke alarms. In the lease it states that when we make our rounds if you didn't already set up an appointment for this then were allowed to go in and do it.. without warning.
My maintenance guys can come in too, but I always make sure everything is out of sight before I leave
that is one thing, but as far as i can tell from the OP's post...it wasnt for anything like that...furniture count... i can only see this as being their business if they provided the furniture and wanted to make sure nothing was replaced or damaged without consent...if it wasnt...well then they fucked up.
Situation sucks, but at least they didn't kick you out. I know in my old apartment's lease if you were caught with ANY type of drug paraphenelia you'd be evicted immediately. It's funny, I lived in the on-campus apartments and I had a small studio apartment, so you couldn't exactly hide shit well. I always left my bong/bud out on the table, and maintenance would come unexpectedly while I was in class at least once a month and they never did anything lol. I'd always see new filters by my AC and be like hrmm, I guess maintenance came.
i could never imagine living at a place where strangers could just let themselves in. if my girlfriend had been changing or there by herself it would be quite a safety concern if someone were able to just let themselves in. If anyone were to enter my place of residence without my expressed verbal or written consent they would most definitely be greeted by the business end of a firearm.
