Aight so my roommate had a party that i wanted nothing to do with so i was in my room the whole night. Cops come but i guess my roommate didn't open the door. So the cops decide to be dicks and give everyone who lived there noise violation tickets. Since i previously had one this one went to $302. Should I go to court for it? And if so what should I plead? Thanks in advance.
fuck that, go to his house, climb in through his window when he's sleeping and slap him with your dick. then run.
If no one answered the door, how did you get a ticket? Even if they just left the tickets on the door or something, they couldn't know how many people lived there or that you live there could they? I say go to court. If you lose, tell your roommate that he owes you $302.
The cop came a few nights later and handed us the tickets. I guess he checked with our landlord or something to find out whos names were all on the lease. But yeah theres no way I myself am going to be paying for it.
Very bad idea to not do anything, either pay the ticket or take it to court. First off, unless you own the property your landlord will be notified and wont be very happy. Haha I remember living in a huge 3 story house with like 10 college kids and having massive raging parties, needless to say we got more than one noise violation, trust me you need to take some action here. Easiest thing to do is just pay the ticket and be careful next time IMO much better than trying to fight it or not do anything at all edit: Different states must handle this differently but when we got tickets, it was for the property rather than each of the individual residents, therefore if you signed the lease then even though you weren't ok with it you are still technically responsible in the eyes of the law sorry man
haha no what i meant by saying i wont be paying for it is that if i dont get it dropped my roommate will be the one footing the bill.
That sucks man, fight the power. Could be worse though, I'm looking at a $350 M.I.P. for being pulled over while drunk in the PASSENGER seat of my friend's car on our way home... 24 hours community service, an alcohol class, and the MADD panel. the shit sucks.
fuck man, did they charge you for being intoxicated in public? One of my friends was fined for 'street drinking' after the cops pulled over the car he was in for a random breath test. He was in the passenger seat and had one beer on him. It could have been worse though, since me another friend were hiding in the boot at the time...
See if you can get a consult with a lawyer in your area to find out the best way to fight these things. If it's just a consult it should only cost $100-$200 which is better than $302. Basically, fighting a ticket works like this: The law says that to be handed a ticket you must meet criteria X, Y, and Z. In the case of "running a red light" this usually means "you went through the light when it was red" "you knew that the light was going to be red when you drove through it" and "you were in full control of your car (i.e. the breaks didn't fail)". Now, the best way to fight this ticket is NOT to argue that the light wasn't red, but rather to argue that one of the other requirements wasn't met. For example, if the stoplight had an unusually short yellow light (the length of the yellow light is supposed to be standardized, but due to lack of maintenance never is), then you can argue that it is the town's fault for failing to maintain their stoplights such that you could reasonably obey traffic signals. Coupled with amateur video of the actual length of the yellow light, this will basically get you off every time. I don't know the laws of your municipality (noise is almost always a town ordinance, so the wording varies A TON from place to place) but you need to speak with someone who does and find out all of the criteria. Then go to court and calmly explain that a non-noise related criteria wasn't met, and that the police have no method of proving that it was met. The police, meanwhile, will be all set with sound recordings and whatnot to demonstrate how loud it was, but that's not the angle you'll be coming from. Bingo, you win.
