So my friend got busted with a ounce, scale, $800, bags, and pipes in his car . He was at this local restaurant chillen outside with a bunch of people, then the officer that arrested him back when he was 17 for possession pulls up and says " you guys can't be hangen out here, and you need to find a new hangout" so my friend says he going home soon anyways. So he leave and the cop knows where he lives so he pulls in a parking lot on the way he would take back to his place, so he's on his way back 2 minutes from his place and guess decides to pull him over the officer from earlier. So he walks up the the car and say he smells pot, and my friend said " I don't do that any more sir I don't know where your getting that smell from". He then tells him to get out of the car and put his hand on the back of his car and ask to search the car, he says no he doesn't consent but he does anyways and finds the shit. So now he's loosing all his weed, 800, and getting charged with a class d felony.

If he said he did not consent and the cop searched anyway regardless of the smell (unless he got a K9 unit) then anything the cop found is inadmissible in court. Probable cause is if the officer sees something (pipe, weed, smoke accessories) he can search but if the stuff was in the trunk then obviously the cop cannot see it. With reasonable suspicion he can get a warrant. Never talk to a cop, they can legally lie to you but if you lie to the cop its a crime. Anytime you get stopped, do NOT consent to searches, Do NOT talk to the cop because they are not your friend, they are trying to get info out of you and ask if you are free to leave.

If a cop smells pot he CAN an WILL search your car. You guys saying otherwise are dumb. Do a google search once in your life.
What's bullshit is the cop probably didn't even smell pot he just wanted to be a dick. sucks for your friend though especially since he had a scale and baggies. it's just plain stupid to ride around with shit like that. when i buy weed i drive straight home, no stops.

[/quote] Not true not true not true not true not true Maybe that's how it goes in YOUR jurisdiction, but here in FL if they say they smell it, the search is legal, regardless of if they have a k9. Why the hell would someone drive with multiple pipes and a scale and hundreds in cash? This is an odd kind of social Darwinism IMO
I am in Oregon and I have been pulled over after hot boxing my car and I know the cop could smell it but he could not search my stuff because I told I do not consent and he said he get a K9 unit out and I told him to go for it. He came back to my car and gave me a ticket for my brake light.
I agree with you that anyone who rides around with all the stuff deserves what they get when they get caught. If we was that stupid in the first place he probably didn't even have good shit to begin with. And if I found out the people I get from were doing that I probably wouldn't buy from them anymore
